Abstract

ABSTRAK Peraturan perusahaan sebagai peraturan yang dibuat secara tertulis oleh pengusaha yang memuat syarat-syarat kerja dan tata tertib perusahaan. Penerapan Pasal 153 Ayat (1) Huruf (f) Undang-Undang Republik Indonesia Nomor 6 Tahun 2023 Tentang Cipta kerja mengenai penghapusan larangan pernikahan sesama pekerja dalam satu perusahaan masih belum direalisasikan. Hal tersebut terjadi karena perusahaan masih memiliki peraturan larangan adanya suami istri bekerja dalam satu perusahaan tujuannya agar pekerja lebih disiplin dan juga profesional dalam melakukan pekerjaan. Rumusan masalah pada penelitian ini adalah bagaimana implementasi Pasal 153 Ayat (1) Huruf (f) Undang-Undang Nomor 6 Tahun 2023 dan bagaimana analisis siyāsah tanfiżiyah terhadap implementasi Pasal 153 Ayat (1) Huruf (f) Undang-Undang Nomor 6 Tahun 2023 mengenai penghapusan larangan pernikahan sesama pekerja di PT. Gema Nusantara Sejahtera Bandar Lampung. Jenis penelitian ini adalah penelitian lapangan (field research). Data yang digunakan yaitu menggunakan data primer dan data sekunder. Metode pengumpulan data dalam penelitian ini adalah dengan melakukan wawancara dan dokumentasi. Metode pengolahan data dilakukan dengan cara pemeriksaan data (editing), pengklasifikasian data (classifying), dan verifikasi data (verifying). Metode analisis data yang digunakan adalah metode deskriptif kualitatif dengan menggunakan metode berpikir induktif. Berdasarkan hasil penelitian dapat disimpulkan bahwa implementasi Pasal 153 Ayat (1) Huruf (f) Undang-Undang Nomor 6 Tahun 2023 mengenai penghapusan larangan pernikahan sesama pekerja di PT. Gema Nusantara Sejahtera Bandar Lampung belum dilaksanakan. Hal ini sangatlah tidak sesuai dengan undang-undang yang berlaku. Ditinjau dari perspektif siyāsah tanfiżiyah, implementasi Pasal 153 Ayat (1) Huruf (f) Undang-Undang Nomor 6 Tahun 2023 di PT. Gema Nusantara Sejahtera Bandar Lampung belum terlaksana sesuai dengan prinsip keadilan dan kesejahteraan yang ada dalam prinsip-prinsip siyāsah tanfiżiyah. The application of Article 153 Paragraph (1) Letter (f) of Law of the Republic of Indonesia Number 6 of 2023 concerning Job Creation regarding the elimination of the prohibition of marriage among workers in one company has not yet been realized. This happens because the company still has a regulation prohibiting husband and wife from working in one company so that workers are more disciplined and also professional in doing work. The formulation of the problem in this study is how the implementation of Article 153 Paragraph (1) Letter (f) of Law Number 6 of 2023 and how the analysis of siyāsah tanfiżiyah on the implementation of Article 153 Paragraph (1) Letter (f) of Law Number 6 of 2023 regarding the elimination of the prohibition of marriage among workers at PT Gema Nusantara Sejahtera Bandar Lampung. This type of research is field research. The data used are primary data and secondary data. The data collection method in this research is by conducting interviews and documentation. Data processing methods are carried out by examining data (editing), classifying data (classifying), and verifying data (verifying). The data analysis method used is descriptive qualitative method using inductive thinking method. Based on the results of the research, it can be concluded that the implementation of Article 153 Paragraph (1) Letter (f) of Law Number 6 of 2023 regarding the elimination of the prohibition of marriage among workers at PT Gema Nusantara Sejahtera Bandar Lampung has not been implemented. This is not in accordance with the applicable law. Viewed from the perspective of siyāsah tanfiżiyah, the implementation of Article 153 Paragraph (1) Letter (f) of Law Number 6 of 2023 at PT Gema Nusantara Sejahtera Bandar Lampung has not been implemented in accordance with the principles of justice and welfare that exist in the principles of siyāsah tanfiżiyah.
