Abstract

ABSTRAK Upah adalah imbalan yang diterima oleh pekerja dari pemberi kerja atas pekerjaan (jasa) yang telah dilakukannya. Dalam Al-Qur‘an dinyatakan setiap manusia akan memperoleh ganjaran (upah/imbalan) atas apa yang dikerjakan. Pemberian upah juga harus memenuhi prinsip keadilan serta kelayakan. Seperti yang ada dalam praktik pengupahan karyawan yang terjadi pada Toko Sumber Murah Busana Desa Kalisari Kecamatan Natar. Melihat dari latar belakang masalah muncul permasalahan yang pertama, bagaimana sistem pengupahan karyawan toko dalam jual beli pakaian? Kedua bagaimana tinjauan hukum Islam terhadap sistem pengupahan karyawan dalam jual beli pakaian?. Adapun tujuan penelitian ini adalah pertama, untuk mengetahui secara mendalam mengenai sistem pengupahan karyawan dalam jual beli pakaian. Kedua untuk mengetahui secara pasti tinjauan hukum Islam terhadap pengupahan karyawan di Toko Sumber Murah Busana. Penelitian ini merupakan penelitian lapangan (field research), yaitu penelitian yang berdasarkan kenyataan di lapangan dalam keadaan sebenarnya. Sifat penelitian ini deskriptif analisis kualitatif, yaitu metode pendekatan yang dalam halnya meneliti suatu objek, status kelompok manusia, suatu kondisi atau suatu sistem pemikiran, atau suatu peristiwa pada masa sekarang. Adapun teknik pengumpulan data dalam penelitian ini adalah dengan melakukan wawancara dan dokumentasi di Toko Sumber Murah Busana. Berdasarkan hasil penelitian, sistem pengupahan karyawan di Toko Sumber murah Busana mengenai upah, pemilik toko telah menetapkan besaran upah yang diterima oleh karyawan live streaming pada awal melakukan perjanjian pekerjaan yaitu sebesar Rp.30.000/hari dan akan dibayarkan setiap bulannya yaitu sebesar Rp. 900.000/bulan. Dalam Tinjauan Hukum Ekonomi Syariah mengenai sistem pengupahan yang ada di Toko Sumber Murah Busana bahwa hukumnya sudah sesuai karena sesuai dengan apa yang dianjurkan oleh Rasulullah SAW yaitu dengan menyebutkan terlebih dahulu besaran upah yang akan diterima oleh pekerja ketika mulai bekerja. Kata Kunci: Upah, Sistem Pengupahan, Hukum Islam. ABSTRACT Wages are compensation received by workers from their employers for the work (services) they have performed. In the Qur'an it is stated that every human being will receive a reward (wages/rewards) for what they do. Remuneration must also meet the principles of fairness and feasibility. As in the employee wage practices that occur at the Sumber Murah Clothing Shop in Kalisari Village, Natar District. Looking at the background of the problem, the first problem arises, what is the wage system for shop employees in buying and selling clothes? Second, what is the Islamic law review of the employee wage system in buying and selling clothes? The aim of this research is first, to find out in depth about the employee wage system in buying and selling clothes. Second, to find out for sure the Islamic law review of employee wages at the Sumber Murah Busana Store. This research is field research, namely research based on reality in the field in actual circumstances. The nature of this research is descriptive qualitative analysis, namely an approach method that examines an object, the status of a human group, a condition or a system of thought, or an event in the present. The data collection technique in this research is by conducting interviews and documentation at the Sumber Murah Busana Store. Based on the research results, the employee wage system at the Sumber Cheap Clothing Store regarding wages, the shop owner has determined the amount of wages received by live streaming employees at the start of the employment agreement, namely IDR 30,000/day and will be paid every month, namely IDR. 900,000/month. In the review of Sharia Economic Law regarding the existing wage system at the Sumber Murah Busana Store, the law is appropriate because it is in accordance with what was recommended by Rasulullah SAW, namely by stating in advance the amount of wages that workers will receive when they start working.
