Abstract

ABSTRAK Satpol PP dibentuk untuk menegakkan Peraturan Daerah dan Peraturan Kepala Daerah, menyelenggarakan ketertiban umum dan ketentraman serta menyelenggarakan perlindungan masyarakat. Kebijakan Pemerintah Kota Bandar Lampung dengan mengeluarkan peraturan Nomor 01 Tahun 2018 tentang Ketentraman Masyarakat dan Ketertiban Umum, Pemerintah Kota Bandar Lampung juga telah mendirikan dan merenovasi bangunan guna menampung volume pedagang kaki lima. Adapun rumusan masalah dalam penelitian ini yaitu (1) Bagaimana implementasi Pasal 30 ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 tentang ketentraman masyarakat dan ketertiban umum terhadap para pedagang kaki lima di Kecamatan Panjang oleh Satuan Polisi Pamong Praja (SatPol PP) Kota Bandar Lampung? (2) Bagaimana tinjauan siyasah tanfidziyah terhadap implementasi Pasal 30 ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 tentang ketentraman masyarakat dan ketertiban umum terhadap para pedagang kaki lima di Kecamatan Panjang Kota Bandar Lampung? Penelitian ini menggunakan metode kualitatif dengan jenis penelitian lapangan (field research), dan sifat penelitian ini bersifat deskriptif analisis yaitu berupa deskriptif, gambaran, atau lukisan secara sistematis dan objektif mengenai fakta-fakta, sifat-sifat tentang bagaimana Implementasi Pasal 30 Ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat Dan Ketertiban Umum Perspektif Siyasah Tanfidziyah, yang bersumber dari wawancara, buku-buku, ataupun arsip dokumen lainnya. Berdasarkan hasil pembahasan dan penelitian dapat disimpulkan bahwa implementasi Pasal 30 Ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat dan Ketertiban Umum terhadap para Pedagang Kaki Lima (PKL) di Kecamatan Panjang oleh SatPol PP Kota Bandar Lampung belum berjalan dengan maksimal. Hal ini disebabkan masih banyaknya Pedagang Kaki Lima (PKL) yang berjualan di kawasan iii Pasar Panjang Bandar Lampung. Solusinya adalah Satpol PP lebih tegas lagi dengan memakai aturan yang membuat jera para pedagang agar tidak berjualan disembarang tempat. Dan Pemerintah Daerah dapat meringankan biaya lapak atau toko untuk para Pedagang Kaki Lima yang ingin berjualan agar sesuai dengan pendapatan yang mereka dapatkan Implementasikan penertiban Pedagang Kaki Lima (PKL) berdasarkan Pasal 30 Ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat dan Ketertiban Umum Pemerintah belum sesuai dengan siyasah tanfidziyah. Hal ini dikarenakan pedagang Kaki Lima (PKL) belum memiliki kesadaran untuk melaksanakan perintah penguasa/pemerintah sebagaimana firman Allah Swt dalam QS. an�Nisa ayat 59. Kata Kunci: Pasar, Ketentraman Masyarakat Dan Ketertiban Umum, Siyasah Tanfidziyah iv ABSTRACT The existence of street vendors can cause social problems, especially for street vendors whose presence interferes with social activities, the beauty of the environment and traffic. Apart from that, it has created new problems, especially disturbing public peace and order. The practice of buying and selling carried out by individuals/business entities has in fact disturbed the comfort of other communities and hampered the mobilization of traffic flow. The formulation of the problem in this research is (1) How is the implementation of Article 30 paragraph 2 of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning public peace and public order for street vendors in Panjang District, Bandar Lampung City? (2) How is siyasah tanfidziyah's review of the implementation of Article 30 paragraph 2 of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning public peace and public order regarding street vendors in Panjang District, Bandar Lampung City? This research uses a qualitative method with the type of field research (field research), and the nature of this research is descriptive analysis, namely in the form of systematic and objective descriptive, description or painting regarding facts, characteristics regarding how to implement Article 30 Paragraph (2) Bandar Lampung City Regional Regulation Number 01 of 2018 Concerning Community Peace and Public Order Perspective of Siyasah Tanfidziyah, which originates from interviews, books, or other document archives. Based on the results of the discussion and research conclusions, it can be concluded that the role of SatPol PP in implementing the control of street vendors (PKL) based on Article 30 Paragraph (2) of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Community Peace and Public Order has not run optimally. This is because there are still many street vendors (PKL) selling in the Pasar Panjang area of Bandar Lampung. The solution is for Satpol PP to be even stricter by using rules that deter traders from selling anywhere. And the Regional Government can reduce the cost of stalls or shops for Street Vendors who want to sell to match the v income they get. Community and Government Public Order are not in accordance with siyasah tanfidziyah. This is because street vendors (PKL) do not have the awareness to carry out orders from the authorities/government as said by Allah SWT in QS. an-Nisa verse 59.
