Abstract

ABSTRAK Penelitian ini mengkaji fenomena perampasan harta warisan berupa tanah pertanian lahan persawahan yang sudah bersertifikat Hak Milik dari perspektif Hukum Keluarga Islam dengan studi pada Putusan Nomor 1/Pdt.G/2024/PN Mna. Tujuan penelitian ini adalah menelaah pertimbangan hukum hakim pada Pengadilan Negeri dalam memutus perkara perampasan harta warisan antara kedua belah pihak yang bersengketa, yang mana orang tua keduanya bersaudara kandung. Masing-masing pihak mengklaim tanah lahan persawahan tersebut adalah warisan dari orang tuanya masing-masing. Penelitian ini merupakan penelitian hukum normatif (normative legal research) dan metode wawancara untuk memperkuat data, pendekatan dilakukan dengan mengkaji hukum sebagai norma atau kaidah yang berlaku dalam masyarakat dengan menitikberatkan pada analisis terhadap peraturan perundang-undangan dan putusan pengadilan. Hasil penelitian ini menunjukkan bahwa Putusan Nomor 1/Pdt.G/2024/PN Mna dalam perkara perampasan harta warisan, mencerminkan upaya penegakan hukum positif dimana hakim memutuskan pengembalian hak kepada Penggugat yang telah memiliki Sertifikat Hak Milik tanah pertanian lahan persawahan, menghukum Tergugat membayar biaya perkara dan menyatakan Tergugat telah melakukan Perbuatan Melawan Hukum (PMH). Pertimbangan hukum tersebut merujuk pada Fikih Mawaris, Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA) pada pasal 20 ayat (1) UUPA, pasal 23 ayat (2) UUPA, Kitab Undang-Undang Hukum Perdata (KUHPerdata) pasal 1365, Pasal 171 huruf (c) KHI serta pasal 183 KHI. Dengan demikian putusan ini menunjukkan adanya relevansi dan integrasi antara hukum positif dengan Hukum Keluarga Islam dalam perlindungan hak ahli waris dan kepastian hukum untuk ahli waris serta menegaskan penegakan keadilan substantif antar anggota keluarga. ABSTRACT This study examines the phenomenon of the misappropriation of an inheritance—specifically, certified freehold agricultural rice fields—from the perspective of Islamic Family Law, focusing on District Court Decision Number 1/Pdt.G/2024/PN Mna. The objective of the research is to analyze the legal reasoning employed by the District Court judge in adjudicating the dispute between two parties whose parents were biological siblings; each party claimed the rice fields as an inheritance from their respective parents. This study employs a normative legal research methodology, supplemented by interviews to reinforce the data; the approach involves examining law as norms or rules applicable within society, with a specific focus on analyzing statutory regulations and court rulings. The findings indicate that Decision Number 1/Pdt.G/2024/PN Mna reflects the enforcement of positive law: the judge ruled for the restoration of rights to the Plaintiff—who held the freehold title certificate for the rice fields—ordered the Defendant to pay court costs, and declared that the Defendant had committed an Unlawful Act (*Perbuatan Melawan Hukum* or PMH). The legal reasoning relied upon *Fiqh Mawaris* (Islamic inheritance jurisprudence), Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA)—specifically Articles 20(1) and 23(2)—Article 1365 of the Indonesian Civil Code (KUHPerdata), and Articles 171(c) and 183 of the Compilation of Islamic Law (KHI). Thus, the decision demonstrates the relevance and integration of positive law and Islamic Family Law in protecting heirs' rights and ensuring legal certainty, while affirming the enforcement of substantive justice among family members.
