Abstract

ABSTRAK Pemenuhan hak penyandang disabilitas merupakan bagian dari perlindungan hak asasi manusia yang wajib dijamin oleh pemerintah, termasuk dalam bidang ketenagakerjaan. Dinas Tenaga Kerja memiliki tugas dan kewenangan dalam melaksanakan kebijakan, pembinaan, pengawasan, serta fasilitasi penempatan kerja bagi penyandang disabilitas sebagaimana diatur dalam Pasal 59 Peraturan Daerah Kota Bandar Lampung Nomor 4 Tahun 2024 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas. Penelitian ini bertujuan untuk menganalisis implementasi Pasal 59 Peraturan Daerah Kota Bandar Lampung Nomor 4 Tahun 2024 oleh Dinas Tenaga Kerja Kota Bandar Lampung serta meninjaunya dalam perspektif Siyasah Tanfidziyah. Penelitian ini merupakan penelitian lapangan dengan pendekatan kualitatif dan jenis penelitian yuridis empiris. Hasil penelitian menunjukkan bahwa Dinas Tenaga Kerja Kota Bandar Lampung telah melakukan berbagai upaya dalam pemenuhan hak kerja penyandang disabilitas melalui pelatihan keterampilan, fasilitasi penempatan kerja, dan koordinasi dengan perusahaan. Implementasinya belum optimal karena masih terdapat perusahaan yang belum memenuhi kuota pekerja disabilitas, keterbatasan data tenaga kerja disabilitas, rendahnya kesadaran pemberi kerja, serta belum maksimalnya pengawasan dan penegakan regulasi. Perspektif siyasah tanfidziyah, pelaksanaan tugas tersebut telah mencerminkan fungsi pemerintahan dalam mewujudkan kemaslahatan dan perlindungan hak kelompok rentan, meskipun masih diperlukan peningkatan efektivitas kebijakan, pengawasan, dan koordinasi antar lembaga. ABSTRACT The fulfillment of the rights of persons with disabilities is an integral part of human rights protection that must be guaranteed by the government, including in the field of employment. The Department of Manpower has the duties and authority to implement policies, provide guidance, conduct supervision, and facilitate employment opportunities for persons with disabilities as stipulated in Article 59 of Bandar Lampung Regional Regulation Number 4 of 2024 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities. This study aims to analyze the implementation of Article 59 of Bandar Lampung Regional Regulation Number 4 of 2024 by the Bandar Lampung Department of Manpower and to examine it from the perspective of Siyasah Tanfidziyah. This research is a field study employing a qualitative approach and an empirical juridical research method. The results indicate that the Bandar Lampung Department of Manpower has undertaken various efforts to fulfill the employment rights of persons with disabilities through skills training, job placement facilitation, and coordination with companies. However, the implementation has not been optimal due to the existence of companies that have not complied with the quota for employing persons with disabilities, limited data on workers with disabilities, low employer awareness, and insufficient supervision and enforcement of regulations. From the perspective of Siyasah Tanfidziyah, the implementation of these duties reflects the government's function in promoting public welfare (maslahah) and protecting the rights of vulnerable groups. Nevertheless, improvements in policy effectiveness, supervision, and inter-agency coordination are still required.
