Abstract

ABSTRAK Penelitian ini mengkaji bias gender dalam kitab Uqud al-Lujain serta relevansinya dengan hukum keluarga Islam kontemporer di Indonesia. Relasi suami–istri dalam kitab tersebut digambarkan secara hierarkis dengan menempatkan perempuan pada posisi subordinat dalam kehidupan rumah tangga. Penelitian ini bertujuan untuk mengidentifikasi bentuk-bentuk bias gender dalam kitab tersebut dan menganalisis kesesuaiannya dengan Kompilasi Hukum Islam dan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Metode yang digunakan adalah penelitian kualitatif berbasis studi pustaka dengan pendekatan deskriptif-analitis. Data penelitian diperoleh dari bahan hukum primer berupa teks Uqud al-Lujain, Kompilasi Hukum Islam, dan Undang-Undang Perkawinan, serta bahan sekunder berupa buku, jurnal ilmiah, dan hasil penelitian terdahulu. Hasil penelitian menunjukkan adanya tiga bentuk bias gender, yaitu pembatasan mobilitas perempuan, subordinasi perempuan dalam relasi rumah tangga, serta legitimasi tindakan disipliner suami terhadap istri. Dalam konteks hukum keluarga Islam kontemporer di Indonesia, pandangan tersebut dinilai kurang relevan karena hubungan keluarga telah berkembang menuju relasi yang lebih setara, saling menghormati, dan menjunjung perlindungan hak individu. Penelitian ini menyimpulkan bahwa reinterpretasi kontekstual terhadap teks-teks fikih klasik diperlukan agar hukum keluarga Islam tetap selaras dengan perkembangan sosial dan prinsip keadilan gender. ABSTRACT This study examines gender bias in the book Uqud al-Lujain and its relevance to contemporary Islamic family law in Indonesia. The discussion of husband–wife relations in the book reflects a hierarchical pattern that places women in a subordinate position within domestic life. This study aims to identify the forms of gender bias contained in the book and analyze their compatibility with the Compilation of Islamic Law and Law Number 1 of 1974 concerning Marriage. The research employs a qualitative method based on library research with a descriptive-analytical approach. Data were collected from primary legal sources, including the text of Uqud al-Lujain, the Compilation of Islamic Law, and the Marriage Law, as well as secondary sources such as books, journal articles, and previous studies. The findings reveal three main forms of gender bias, namely restrictions on women’s mobility, the subordination of women in marital relations, and the legitimization of husbands’ disciplinary actions toward wives. In the context of contemporary Islamic family law in Indonesia, these perspectives are considered less relevant because family relations have shifted toward principles of equality, mutual respect, and protection of individual rights. The study concludes that contextual reinterpretation of classical Islamic texts is necessary in order to create more just, balanced, and responsive family relations in accordance with contemporary social developments and gender justice principles.
