Abstract
ABSTRAK Penelitian ini dilatar belakangi oleh adanya perubahan nisbah bagi hasil secara sepihak pada akad mukhabarah yang terjadi di Kelurahan Tanjung Senang Bandar Lampung. Pada awal kerja sama, pemilik sawah dan petani penggarap menyepakati nisbah bagi hasil sebesar 1:2, yaitu satu bagian untuk pemilik sawah dan dua bagian untuk petani penggarap, dengan seluruh biaya produksi ditanggung oleh penggarap. Namun, pada masa panen berikutnya, pemilik sawah mengubah nisbah secara sepihak menjadi 1:1 tanpa adanya musyawarah dan persetujuan dari petani penggarap. Penelitian ini bertujuan untuk menganalisis praktik bagi hasil antara pemilik sawah dan penggarap serta menganalisis perubahan nisbah tersebut dalam perspektif Hukum Ekonomi Syariah. Penelitian ini menggunakan jenis penelitian lapangan (field research) dengan pendekatan kualitatif deskriptif. Hasil penelitian menunjukkan bahwa praktik bagi hasil pada awalnya dilakukan berdasarkan kesepakatan lisan dengan nisbah 1:2. Perubahan nisbah menjadi 1:1 dilakukan secara sepihak oleh pemilik sawah tanpa persetujuan penggarap sehingga menyebabkan berkurangnya hak dan menimbulkan kerugian bagi penggarap. Dalam perspektif Hukum Ekonomi Syariah, perubahan nisbah tersebut tidak dapat dibenarkan karena bertentangan dengan prinsip an-taradhin (saling ridha), keadilan (al-'adl), dan kewajiban memenuhi akad (wafa' bil 'uqud), serta dapat dikategorikan sebagai wanprestasi. Nisbah yang berlaku seharusnya tetap mengacu pada kesepakatan awal, yaitu 1:2. Selain itu, kebiasaan nisbah 1:2 yang telah berlangsung secara turun-temurun dapat menjadi 'urf shahih selama tidak bertentangan dengan syariah. ABSTRACT This research is motivated by the unilateral change in the profit-sharing ratio in a mukhabarah contract in Tanjung Senang Village, Bandar Lampung. At the beginning of the cooperation, the rice field owner and the farmer agreed on a profit-sharing ratio of 1:2, with one share allocated to the landowner and two shares to the farmer, while all production costs were borne by the farmer. However, during the following harvest, the landowner unilaterally changed the ratio to 1:1 without consultation or agreement from the farmer. This study aims to analyze the profit-sharing practice between the landowner and the farmer and to examine the unilateral change in the ratio from the perspective of Sharia Economic Law. This research employed a field research method with a descriptive qualitative approach. The results show that the initial profit-sharing practice was based on an oral agreement with a ratio of 1:2. The unilateral change to a 1:1 ratio reduced the farmer's agreed share and caused financial loss because the farmer was responsible for the production costs and labor. From the perspective of Sharia Economic Law, the unilateral change cannot be justified because it violates the principles of mutual consent (an-taradhin), justice (al-'adl), and fulfillment of contractual obligations (wafa' bil 'uqud), and may be categorized as a breach of contract. Therefore, the applicable ratio should remain based on the initial agreement, namely 1:2. Furthermore, the 1:2 ratio that has been practiced traditionally may constitute 'urf shahih as long as it does not contradict Islamic principles.
