Abstract

ABSTRAK Penelitian ini dilatarbelakangi oleh adanya titik temu sekaligus ketegangan konseptual antara pemikiran politik Barat modern dan hukum tata negara Islam terkait sumber kedaulatan dalam sebuah negara. Jean-Jacques Rousseau melalui gagasan Kontrak Sosialnya memperkenalkan konsep kedaulatan rakyat yang mutlak dan tidak dapat diwakilkan, di mana hukum harus bersumber dari Kehendak Umum (volonté générale). Di sisi lain, Fiqh Siyāsah (ketatanegaraan Islam) secara epistemologis menempatkan kedaulatan tertinggi berada di tangan Allah Swt. (ḥākimiyyah), namun dalam pelaksanaannya memberikan ruang bagi manusia melalui konsep kekhalifahan dan musyawarah (syūrā). Rumusan masalah dalam penelitian ini adalah bagaimana analisis Fiqh Siyāsah terhadap konsep kedaulatan rakyat menurut Jean-Jacques Rousseau dan bagaimana implikasinya terhadap konsep keterwakilan politik. Penelitian ini merupakan penelitian hukum normatif atau studi pustaka (library research) dengan menggunakan pendekatan konseptual dan komparatif. Analisis penelitian menggunakan Teori Kontrak Sosial (Social Contract Theory) Jean-Jacques Rousseau, menyatakan bahwa negara lahir dari suatu perjanjian sosial antara individu-individu yang sepakat membentuk masyarakat politik demi mewujudkan kepentingan bersama. Dalam teori ini, kedaulatan berada di tangan rakyat dan diwujudkan melalui kehendak umum (volonté générale), sehingga setiap hukum yang berlaku harus mencerminkan kehendak bersama, bukan kepentingan individu atau golongan tertentu. Teori Kedaulatan dalam Fiqh Siyāsah (Siyāsah Dustūriyyah) yang menitikberatkan pada konsep ḥākimiyyah, syūrā, dan bai'at, serta teori maqāṣid al-Syarī‘ah sebagai instrumen untuk menilai kemaslahatan dalam penyelenggaraan pemerintahan. Data dianalisis secara kualitatif-deskriptif. Hasil penelitian menunjukkan bahwa Fiqh Siyāsah dan pemikiran Rousseau memiliki titik kesamaan (konvergensi) dalam menempatkan rakyat sebagai pemegang otoritas pelaksanaan pemerintahan dan penolakannya terhadap kekuasaan absolut tirani. Namun, terdapat perbedaan mendasar (divergensi) pada sumber hukum tertinggi; Rousseau menolak segala bentuk hukum di luar kehendak manusia, sementara Fiqh Siyāsah membatasi kehendak rakyat agar tidak bertentangan dengan prinsip-prinsip syariat (maqāṣid al-syarī‘ah). Temuan ini menunjukkan bahwa konsep partisipasi rakyat dapat diterima dalam perspektif Fiqh Siyāsah sepanjang tetap berada dalam koridor nilai-nilai syariat dan kemaslahatan umum. ABSTRACT This research is motivated by the intersection and conceptual tension between modern Western political thought and Islamic constitutional law regarding the source of sovereignty within a state. Jean-Jacques Rousseau, through his Social Contract, introduced the concept of absolute and nondelegable popular sovereignty, where law must originate from the General Will (volonté générale). On the other hand, Islamic jurisprudence (Fiqh Siyāsah) epistemologically places supreme sovereignty in the hands of Allah SWT (ḥākimiyyah), but in its implementation, it provides space for humans through the concepts of the caliphate and deliberation (shūrā). The research problem is how Islamic jurisprudence analyzes Jean-Jacques Rousseau's concept of popular sovereignty and its implications for the concept of political representation. This research is a normative legal research or library research using a conceptual and comparative approach. The research analysis uses JeanJacques Rousseau's Social Contract Theory, which states that the state was born from a social agreement between individuals who agreed to form a political society to realize common interests. In this theory, sovereignty is in the hands of the people and is realized through the general will (volonté générale), so that every applicable law must reflect the common will, not the interests of certain individuals or groups. The theory of Sovereignty in Fiqh Siyāsah (Siyāsah Dustūriyyah) emphasizes the concepts of ḥākimiyyah, shūrā, and bai'at, as well as the theory of maqāṣid al-Syarī‘ah as an instrument to assess the benefit in the administration of government. The data were analyzed qualitatively-descriptively. The results of the study show that Fiqh Siyāsah and Rousseau's thoughts have a point of similarity (convergence) in placing the people as the holders of the authority to implement government and their rejection of absolute tyrannical power. However, there is a fundamental difference (divergence) in the highest source of law; Rousseau rejects all forms of law outside of human will, while Fiqh Siyāsah limits the will of the people so that it does not conflict with the principles of sharia (maqāṣid al-syarī‘ah). This finding indicates that the concept of popular participation is acceptable from the perspective of Fiqh Siyāsah as long as it remains within the corridor of sharia values and the public interest.
