Abstract

Abstract: This study examines the dialectic between classical Islamic political thought and the modern representative democratic system through the analysis of the relevance of the concept of Ahlul Halli wal 'Aqdi (AHWA) put forward by Al-Mawardi. So far, the study of AHWA has generally stopped at normative readings or attempts to find structural conformity with modern democracy, without adequately explaining the conceptual tension between the legitimacy of sharia and the sovereignty of the people and their implications for contemporary democratic practices. The main problem in this study lies in the 1 2 differences in the source of legitimacy of power, the mechanism of selecting leaders, and the form of political representation between the classical Islamic system of government and modern democracy. This study uses a qualitative-descriptive method with a library research approach, by analyzing Al-Mawardi's thoughts in Al-Ahkam al Sulthaniyyah and comparing them with the principles of representative democracy. The results of the study show that although structurally and procedurally different AHWA from modern democratic institutions, they have substantive similarities, especially in the principles of representation, limitation of power, accountability, and deliberation. AHWA emphasizes legitimacy based on moral qualities and intellectual capacity, while modern democracy emphasizes procedural legitimacy through popular participation. This research contributes to the normative reconstruction of Islamic political thought by placing AHWA as an ethical framework and a model of substantive representation that can enrich modern representative democracy so that it is not merely procedural, especially in the context of Muslim society. Abstrak: Penelitian ini mengkaji dialektika antara pemikiran politik Islam klasik dan sistem demokrasi representatif modern melalui analisis relevansi konsep Ahlul Halli wal ‘Aqdi (AHWA) yang dikemukakan oleh Al-Mawardi. Sejauh ini, kajian tentang AHWA umumnya berhenti pada pembacaan normatif atau upaya mencari kesesuaian struktural dengan demokrasi modern, tanpa secara memadai menjelaskan ketegangan konseptual antara legitimasi syariat dan kedaulatan rakyat serta implikasinya bagi praktik demokrasi kontemporer. Permasalahan utama dalam penelitian ini terletak pada perbedaan sumber legitimasi kekuasaan, mekanisme pemilihan pemimpin, serta bentuk representasi politik antara sistem pemerintahan Islam klasik dan demokrasi modern.Penelitian ini menggunakan metode kualitatif-deskriptif dengan pendekatan library research, dengan menganalisis pemikiran Al Mawardi dalam Al-Ahkam al-Sulthaniyyah serta membandingkannya dengan prinsip-prinsip demokrasi representatif. Hasil penelitian menunjukkan bahwa meskipun secara struktural dan prosedural AHWA berbeda dengan lembaga demokrasi modern, keduanya memiliki kesamaan substantif, khususnya dalam prinsip representasi, pembatasan kekuasaan, akuntabilitas, dan musyawarah. AHWA menekankan legitimasi berbasis kualitas moral dan kapasitas intelektual, sementara demokrasi modern menekankan legitimasi prosedural melalui partisipasi rakyat. Penelitian ini berkontribusi pada rekonstruksi normatif pemikiran politik Islam dengan menempatkan AHWA sebagai kerangka etik dan model representasi substantif yang dapat memperkaya demokrasi representatif modern agar tidak semata bersifat prosedural, khususnya dalam konteks masyarakat Muslim.
