Abstract
ABSTRAK Perkembangan teknologi informasi telah mendorong pesatnya praktik jual beli secara online dengan berbagai sistem transaksi, salah satunya adalah sistem war, yaitu metode pembelian barang yang dilakukan secara cepat karena jumlah barang terbatas dan tingginya permintaan. Sistem ini banyak digunakan pada penjualan produk baju, barang koleksi, maupun produk edisi terbatas. Meskipun memberikan kemudahan bagi pelaku usaha dan konsumen, sistem war menimbulkan berbagai persoalan hukum, seperti kejelasan akad, transparansi informasi, potensi gharar (ketidakjelasan), serta keadilan dalam proses transaksi. Penelitian ini bertujuan untuk menganalisis praktik jual beli online sistem war berdasarkan perspektif Hukum Ekonomi Syariah. Metode penelitian yang digunakan adalah penelitian deskriptif kualitatif untuk memperoleh kesimpulan mengenai kesesuaian praktik tersebut dengan prinsip-prinsip syariah. Hasil penelitian menunjukkan bahwa jual beli online sistem war pada dasarnya diperbolehkan dalam Hukum Ekonomi Syariah selama memenuhi rukun dan syarat jual beli, yaitu adanya penjual dan pembeli yang cakap hukum, objek yang halal dan jelas, harga yang diketahui, serta adanya ijab dan kabul yang menunjukkan kerelaan kedua belah pihak. Namun, apabila dalam pelaksanaannya terdapat unsur gharar, penipuan (tadlis), manipulasi, ketidakjelasan stok, atau praktik yang merugikan salah satu pihak, maka transaksi tersebut bertentangan dengan prinsip keadilan dan kemaslahatan dalam syariah. Oleh karena itu, penerapan sistem war harus mengedepankan transparansi, kejujuran, dan kepastian hukum agar transaksi berlangsung sesuai dengan prinsip-prinsip Hukum Ekonomi Syariah. ABSTRACT Advancements in information technology have spurred the rapid growth of online trading utilizing various transaction systems; one such method is the "war" system—a rapid purchasing process driven by limited stock and high demand. This system is frequently employed for the sale of apparel, collectibles, and limited-edition products. While offering convenience to both businesses and consumers, the "war" system gives rise to various legal issues, such as the clarity of the contract, information transparency, the potential for gharar (uncertainty), and fairness within the transaction process.This study aims to analyze the "war" system of online trading from the perspective of Sharia Economic Law. A qualitative descriptive research method was employed to determine the extent to which this practice aligns with Sharia principles. The research findings indicate that the "war" system of online trading is fundamentally permissible under Sharia Economic Law, provided it satisfies the essential elements and conditions of a sale: the presence of legally competent parties (seller and buyer), a lawful and clearly defined object, a known price, and an offer and acceptance (ijab and qabul) that reflect the mutual consent of both parties. However, if the execution involves elements of gharar, fraud (tadlis), manipulation, stock ambiguity, or practices that disadvantage one party, the transaction conflicts with the Sharia principles of justice and public interest (maslahah). Therefore, the implementation of the "war" system must prioritize transparency, honesty, and legal certainty to ensure transactions comply with the principles of Sharia Economic Law.
