Abstract
ABSTRAK Latar belakang penelitian ini dipicu oleh maraknya tren penggunaan stiker distributor store (clothing/distro) di kalangan remaja, di mana Toko Customin Lampung menjadi salah satu penyedia custom stiker tersebut. Namun, dalam praktiknya terdapat beberapa desain stiker yang memuat konten visual maupun tekstual yang bertolak belakang dengan nilai-nilai dan etika Islam, seperti gambar yang mengumbar aurat, simbol-simbol yang dilarang, hingga frasa yang mengandung unsur provokatif atau amoral. Jual beli objek yang mengandung kemudaratan menimbulkan pertanyaan mendasar mengenai keabsahan transaksi tersebut dalam perspektif muamalah. Penelitian ini bertujuan untuk mengidentifikasi jenis-jenis stiker yang bertolak belakang dengan syariat Islam yang dijual di Toko Customin Lampung serta menganalisis bagaimana tinjauan hukum ekonomi syariah terhadap praktik jual beli stiker distributor store tersebut. Penelitian ini merupakan jenis penelitian lapangan (field research) yang bersifat deskriptif-analitis dengan menggunakan pendekatan kualitatif. Data primer diperoleh langsung melalui observasi di Toko Customin Lampung serta wawancara mendalam dengan pemilik toko dan dua karyawan. Data sekunder bersumber dari literatur muamalah, buku hukum ekonomi syariah, jurnal ilmiah, dan dokumen relevan lainnya. Metode pengumpulan data dilakukan melalui observasi, wawancara, dan dokumentasi. Setelah data terkumpul, analisis data dilakukan secara kualitatif menggunakan metode berpikir induktif, yakni menarik kesimpulan dari fakta-fakta khusus yang ditemukan di lapangan untuk kemudian ditarik ke dalam teori hukum ekonomi syariah yang bersifat umum. Hasil penelitian ini menunjukkan bahwa: Pertama, jenis stiker yang dijual di Toko Customin Lampung yang bertolak belakang dengan Islam meliputi stiker dengan visualisasi ilustrasi pornografi/mengumbar aurat, stiker dengan simbol keagamaan non-Muslim atau satanisme, serta stiker bertuliskan kata-kata kasar/makian yang mengabaikan akhlakul karimah. Kedua, dalam tinjauan hukum ekonomi syariah, praktik jual beli stiker distributor store yang mengandung unsur maksiat dan kemudaratan tersebut hukumnya adalah tidak sah atau batil. Hal ini dikarenakan objek akad (ma'qud 'alaih) tidak memenuhi syarat kehalalan pemanfaatan barang dalam Islam. Berdasarkan prinsip-prinsip hukum ekonomi syariah, suatu komoditas yang diperjualbelikan harus memiliki nilai guna yang murni (mubah) dan tidak mendatangkan mafsadah (kerusakan moral). Oleh karena itu, keuntungan yang diperoleh dari penjualan stiker berkonten negatif tersebut dikategorikan sebagai pendapatan yang tidak tayyib, sedangkan untuk stiker distro yang berdesain netral atau positif, hukum jual belinya tetap diperbolehkan (mubah). ABSTRACT The background of this research is triggered by the widespread trend of using distributor store (clothing/distro) stickers among adolescents, where Toko Customin Lampung operates as one of the providers for these custom stickers. However, in practice, several sticker designs feature visual and textual content that contradicts Islamic values and ethics, such as images exposing awrah, prohibited symbols, and phrases containing provocative or immoral elements. The buying and selling of objects containing harm (mudarat) raises a fundamental question regarding the validity of such transactions from a muamalah perspective. This study aims to identify the types of stickers sold at Toko Customin Lampung that contradict Islamic sharia and to analyze the Islamic Economic Law perspective on the buying and selling practices of these distributor store stickers. This research is a field research that is descriptive-analytical in nature, utilizing a qualitative approach. Primary data were obtained directly through observations at Toko Customin Lampung and in-depth interviews with the shop owner and two employees. Secondary data were sourced from muamalah literature, Islamic Economic Law books, scientific journals, and other relevant documents. Data collection methods were conducted through observation, interviews, and documentation. Data were analyzed qualitatively using an inductive reasoning method, which involves drawing conclusions from specific facts found in the field to be contextualized within the general theories of Islamic Economic Law. The results of this study indicate that: First, the types of stickers sold at Toko Customin Lampung that contradict Islam include stickers with visual pornographic illustrations/exposing awrah, stickers with non-Muslim religious or satanic symbols, and stickers containing harsh words/profanity that disregard akhlakul karimah (noble character). Second, from the perspective of Islamic Economic Law, the practice of buying and selling distributor store stickers that contain elements of sin and harm is invalid or void (batil). This is because the object of the contract (ma'qud 'alaih) does not meet the sharia requirement regarding the permissibility of product utilization in Islam. Based on the principles of Islamic Economic Law, a traded commodity must possess pure utility value (mubah) and must not lead to mafsadah (moral damage). Consequently, the profit earned from selling these negative-content stickers is categorized as non-tayyib (unwholesome) income, whereas the buying and selling of distro stickers with neutral or positive designs remains permissible (mubah).
