Abstract
ABSTRAK Penelitian ini adanya kesenjangan antara regulasi normatif implementasi riil terkait pemenuhan hak-hak mantan istri dan anak pasca percerian khususnya dalam perkara cerai gugat pada praktiknya, hak seperti nafkah idah dan mut’ah lebih sering di berikan pada perkara cerai talak, sedangkan dalam cerai gugat sering kali diabaikan atau tidak di mohonkan secara tegas oleh pengugat Putusan Pengadilan Agama Kalianda Nomor 407/Pdt.G/2025/PA.Kla yang menunjukan adanya progresivitas hakim dalam mengunakan kewenangan ex officio untuk melindungi hak kelompok rentan. Permasalahan hukum dalam penelitian ini adalah bagaimana perlindungan hukum terhadap hak hadanah, nafkah anak, nafkah idah, dan mut’ah diberikan ketika perceraian disebabkan adanya konflik rumah tangga, ketidaktranparan ekonomi penelantaran nafkah, dan kekerasan rumah tangga (KDRT). Apabila Tergugat tidak memenuhi nafkah dalam putusan tersebut, maka Penggugat dapat mengajukan eksekusi putusan. Putusan ini dipilih karena menunjukkan adanya penggunaan kewenangan ex officio hakim, menjalakan amanat UndangUndang Nomor 16 Tahun 2019, PERMA 3 Tahun 2017, dan Pasal 77- 84 & Pasal 149 Kompilasi Hukum Islam (KHI) dalam menetapkan hakhak perempuan dan anak meskipun perkara diajukan melalui cerai gugat. Penelitian menggunakan metode yuridis-normatif dengan pendekatan perundang-undangan dan studi putusan pengadilan. Hasil penelitian menunjukkan bahwa hakim tidak hanya mempertimbangkan aspek yuridis formal, tetapi juga aspek sosiologis dan kepentingan terbaik bagi anak (the best interest of the child). Putusan ini mencerminkan adanya harmonisasi dan integrasi yang seimbang antara hukum Islam, hukum positif, dan prinsip hak asasi manusia. Pelaksanaan pasca putusan akta cerai tergugat di tahan oleh Panitera sampai ia melunasi seluruh kewajiban nafkah, penggugat menerima nafkah idah Rp.4.500.000 dan mut’ah Rp.3.000.000 melalui kewenangan ex officio hakim, menjalakan amanat Undang-Undang Nomor 16 Tahun 2019, PERMA 3 Tahun 2017, dan Pasal 77-84 & Pasal 149 Kompilasi Hukum Islam (KHI). ABSTRACT This study addresses the gap between normative regulations and actual implementation regarding the fulfillment of the rights of ex-wives and children post-divorce specifically in cerai gugat divorce initiated by the wife cases. In practice, rights such as iddah they are often overlooked or not explicitly requested by the plaintiff. Religious Court of Kalianda Decision Number 407/Pdt.G/2025/PA.Kla demonstrates judicial progressiveness in exercising ex officio authority to protect the rights of vulnerable groups. The legal issue examined here concerns the legal protection afforded to rights regarding child custody hadanah, child maintenance, iddah maintenance, and mut’ah when divorce arises from domestic conflict, financial lack of transparency, failure to provide maintenance, and domestic violence. If the defendant fails to fulfill the maintenance obligations stipulated in the ruling, the plaintiff may apply for the execution of the judgment. This decision was selected because it illustrates the judge's exercise of ex officio authority upholding the mandates of Law Number 16 of 2019, Supreme Court Regulation PERMA Number 3 of 2017, and Articles 77–84 and 149 of the Compilation of Islamic Law (KHI) to establish the rights of women and children, even though the case was initiated via cerai gugat. The study employs a normative-juridical method, utilizing statutory and case-law analysis approaches. The findings indicate that the judge considered not only formal legal aspects but also sociological factors and the best interests of the child. The decision reflects a balanced harmonization and integration of Islamic law, positive law, and human rights principles. Following the judgment, the issuance of the divorce deed to the defendant is withheld by the Court Clerk until he has fully settled all maintenance obligations; the plaintiff receives iddah maintenance of IDR 4,500,000 and *mut’ah* (consolation gift) of IDR 3,000,000 pursuant to the judge's ex officio authority and in accordance with the mandates of Law Number 16 of 2019, Supreme Court Regulation (PERMA) Number 3 of 2017, and Articles 77–84 and Article 149 of the Compilation of Islamic Law (KHI)
