Abstract

ABSTRAK Pernikahan membuat suami secara otomatis menjadi imam dalam sebuah rumah tangga. Peran suami teramat penting mengingat bahwa seorang suami menjadi penentu arah dan jalan rumah tangga tersebut. Murtad, sebagai salah satu isu teologis yang kompleks dalam Islam telah menjadi fokus perhatian berbagai ulama dan ahli fikih sepanjang sejarah. Istilah ini, yang secara bahasa bermakna "kembali" (rujū‘), memiliki konotasi teologis mendalam sebagai tindakan meninggalkan agama Islam setelah sebelumnya beriman. Fenomena kemurtadan tidak hanya memiliki implikasi keagamaan, tetapi juga berdampak pada aspek hukum dan sosial. Dalam konteks hukum Islam, murtad dianggap sebagai pelanggaran serius terhadap keyakinan dan tatanan umat Islam. Hukuman yang dijatuhkan bagi pelaku murtad mencerminkan upaya untuk menjaga kemurnian ajaran Islam dan integritas komunitas Muslim. Pendekatan terhadap murtad berbeda-beda di antara mazhab-mazhab fikih, yang mencerminkan keragaman pandangan dalam memahami dan mengimplementasikan hukum syariat. Rumusan masalah pada penelitian ini ialah bagaimana dampak apostasi suami terhadap keabsahan pernikahan? dan Bagaimana pandangan hukum Islam terhadap perbuatan apostasi yang dilakukan oleh suami setelah akad nikah?. Penelitian ini merupakan penelitian lapangan (field research) dengan menggunakan metode kualitatif yang bersifat deskriptif serta analisa dengan menggunakan metode induktif. Data yang digunakan pada penelitian ini terdiri dari data primer yang bersumber dari informan di Desa Terbaya Kecamatan Kota Agung Kabupaten Tanggamus serta menggunakan data sekunder yang diperoleh dari buku-buku yang relevan. Hasil penelitian ini menunjukan bawah dampak hukum apostasi sangat signifikan terhadap keabsahan pernikahan. Istri yang ditinggalkan oleh suami murtad memiliki beberapa implikasi hukum. Pertama, ia tidak lagi terikat sebagai istri sah, kecuali dalam pandangan mazhab Hanafi selama masa iddah. Kedua, ia tidak berhak menuntut nafkah dari suami yang murtad. Ketiga, menurut jumhur, ia boleh menikah dengan laki-laki muslim lain setelah memastikan fasakh terjadi. Keempat, ia dianjurkan menjaga akidahnya, karena pernikahan dengan non-muslim dilarang keras. Pandangan hukum Islam terhadap perbuatan apostasi suami setelah akad nikah menegaskan bahwa tindakan tersebut merupakan pelanggaran serius terhadap prinsip dasar perkawinan sebagai mītsāqan galīẓan. Apostasi dipandang tidak hanya meruntuhkan ikatan keagamaan dalam rumah tangga, tetapi juga menghapus hak dan kewajiban suami istri, serta menggugurkan posisi suami sebagai qawwām. Hukum Islam memandang putusnya perkawinan karena apostasi juga sebagai bentuk perlindungan terhadap istri agar tidak hidup dalam perkawinan yang dapat mengancam akidahnya. Hasil wawancara dengan responden memperkuat pandangan ini, karena secara sosiologis istri merasa pernikahan kehilangan sakralitasnya dan menolak melanjutkan kehidupan rumah tangga dengan suami yang murtad. ABSTRACT After marriage, the husband automatically becomes the imam (leader) of the household. The husband's role is crucial, given that he determines the direction and path of the household. Apostasy, as a complex theological issue in Islam, has been the focus of attention of various scholars and jurists throughout history. This term, which literally means "return" (rujū‘), has profound theological connotations, representing the act of abandoning Islam after previously believing in it. The phenomenon of apostasy has not only religious implications but also legal and social implications. Within the context of Islamic law, apostasy is considered a serious violation of the beliefs and order of the Muslim community. The punishments imposed on apostates reflect efforts to maintain the purity of Islamic teachings and the integrity of the Muslim community. On the other hand, approaches to apostasy vary among Islamic schools of jurisprudence, reflecting diverse perspectives on understanding and implementing Sharia law. The research question is: What is the legal impact of a husband's apostasy on the validity of a marriage according to Islamic law and what is the Islamic legal perspective on apostasy committed by a husband after the marriage contract? The purpose of this research is to determine the legal impact of a husband's apostasy on the validity of a marriage according to Islamic law and to determine the Islamic legal perspective on apostasy committed by a husband after the marriage contract. This research is field research using descriptive qualitative methods and inductive analysis. The data used in this study consist of primary data sourced from the husband and wife, data from Terbaya Village, and secondary data obtained from relevant books. A husband's apostasy after the marriage contract has significant legal implications on the validity of the marriage. A wife abandoned by an apostate husband has several legal implications. First, she is no longer legally bound as a wife, except according to the Hanafi school of thought during the iddah period. Second, she has no right to demand maintenance from her apostate husband. Third, according to the majority, she may marry another Muslim man after ensuring that she has been declared apostate. Fourth, she is encouraged to maintain her faith, as marriage with a nonMuslim is strictly prohibited. The Islamic legal perspective on the act of apostasy after the marriage contract confirms that it constitutes a serious violation of the fundamental principle of marriage as a mītsāqan galīẓan (partial commitment). Apostasy is seen not only as destroying the religious bond within the household but also as nullifying the rights and obligations of husband and wife, and invalidating the husband's position as qawwām (partial commitment). Islamic law also views the dissolution of a marriage due to apostasy as a form of protection for the wife from living in a marriage that could threaten her faith. Interviews with respondents support this view, as sociologically, wives feel that their marriage has lost its sacredness and refuse to continue living with their apostate husbands.
