Abstract

Abstract Mountain motorcycle taxis (ojek gunung) constitute the primary means of mobility for residents of Atar Lebar Village, which is characterized by hilly geography and limited road access. In practice, the determination of fares for mountain motorcycle taxi services is conducted flexibly without written tariff standards, potentially giving rise to issues of fairness in transactions. This study aims to analyze the pricing practices of mountain motorcycle taxi services and to assess their conformity with the principles of Islamic Economic Law. The research employs a qualitative field research method, with data collected through in-depth interviews, observation, and documentation involving both drivers and service users. Data analysis is conducted using a descriptive qualitative approach with an inductive perspective based on the principles of ijarah contracts, justice (al-‘adl), mutual consent (tarāḍin), and the prohibition of gharar. The findings indicate that fare determination is carried out through mutual agreement between drivers and passengers by considering factors such as terrain conditions, travel distance, weather, travel time, and occupational risks. Normatively, this practice fulfills the pillars and conditions of the ijarah contract and is therefore permissible under Islamic Economic Law. However, weaknesses remain in terms of transparency and balance of bargaining power, particularly in urgent situations where passengers tend to occupy a weaker position. Consequently, while the pricing practice of mountain motorcycle taxi services is legally valid from a Sharia perspective, it requires reinforcement of muamalah ethics to ensure greater fairness, transparency, and orientation toward public welfare.
