Abstract

ABSTRAK UNDANG UNDANG CIPTA KERJA DALAM PERSPEKTIF KEADILAN SOSIAL ISLAM Oleh: DEDE ASRIANI Penelitian ini mengkaji Undang-Undang Cipta Kerja dalam perspektif keadilan sosial Islam dengan menitikberatkan pada keselarasan antara tujuan regulasi ketenagakerjaan dan nilai-nilai keadilan dalam Islam. Fokus penelitian diarahkan pada perlindungan hak pekerja, keseimbangan hubungan antara negara, pengusaha, dan tenaga kerja, serta upaya mewujudkan kemaslahatan umum di tengah dinamika pembangunan ekonomi. Penelitian ini menggunakan pendekatan kualitatif dengan metode penelitian pustaka (library research). Data diperoleh dari teks Undang-Undang Cipta Kerja, literatur hukum, jurnal ilmiah, serta sumber-sumber pemikiran Islam yang membahas keadilan sosial dan maqāṣid al-syari„ah. Analisis dilakukan secara normatif-kritis dengan pendekatan hermeneutika untuk menafsirkan ketentuan hukum dalam dialog dengan nilai-nilai keadilan sosial Islam. Hasil penelitian menunjukkan bahwa Undang-Undang Cipta Kerja sebagaimana ditegaskan melalui Undang-Undang Nomor 6 Tahun 2023 bertujuan mendorong pertumbuhan ekonomi dan stabilitas hubungan industrial. Kehadiran Jaminan Kehilangan Pekerjaan, pengaturan kompensasi PKWT, dan mekanisme PHK menunjukkan upaya negara menjaga stabilitas sosial ekonomi, tetapi masih memerlukan penguatan perlindungan terhadap kelompok pekerja rentan agar selaras dengan nilai kemaslahatan dan keadilan berkeadaban. ABSTRACT UNDANG UNDANG CIPTA KERJA DALAM PERSPEKTIF KEADILAN SOSIAL ISLAM Oleh: DEDE ASRIANI This study examines the Job Creation Law from the perspective of Islamic social justice, focusing on the alignment between labor regulations and Islamic principles of justice. The analysis emphasizes the protection of workers‟ rights, the balance of relations among the state, employers, and workers, and the pursuit of public welfare within the context of economic development. This research employs a qualitative approach using library research methods. Data are collected from the text of the Job Creation Law, legal literature, academic journals, and Islamic scholarly sources discussing social justice and maqāṣid al-sharī„ah. The data are analyzed through a normative-critical and hermeneutic approach to interpret legal provisions in relation to Islamic values of social justice. The findings indicate that the Job Creation Law, as reaffirmed through Law Number 6 of 2023, aims to promote economic growth and industrial stability. Although provisions such as unemployment insurance, compensation for fixed-term workers, and the regulation of employment termination demonstrate the state‟s effort to maintain socio-economic stability, stronger protection for vulnerable workers is still required to align the law with the values of public welfare and equitable justice.
