Abstract

ABSTRAK Praktik talak melalui siaran langsung di media sosial menghadirkan problematika baru dalam ranah hukum keluarga Islam, terutama menyangkut aspek keabsahan, etika, dan konsekuensi hukumnya. Fokus permasalahan penelitian ini adalah bagaimana kedudukan talak live dalam perspektif fikih serta bagaimana penilaiannya menurut hukum positif dan maqasid syari„ah. Penelitian ini bertujuan untuk mengkaji validitas talak yang disampaikan melalui live streaming sekaligus menganalisis implikasinya dari sudut pandang etika dan perlindungan nilai-nilai kemanusiaan. Metode yang digunakan adalah studi kepustakaan dengan pendekatan yuridis normatif melalui telaah terhadap literatur fikih klasik dan kontemporer, doktrin hukum, putusan pengadilan, serta berbagai sumber ilmiah terkait. Temuan penelitian menunjukkan bahwa secara fikih, talak yang diucapkan secara live dapat dinilai sah apabila memenuhi rukun dan syarat, seperti dilakukan oleh suami yang baligh, berakal, sadar, dan menggunakan lafaz yang tegas atau disertai niat. Akan tetapi, dalam sistem hukum positif, perceraian baru memiliki kekuatan hukum setelah adanya putusan pengadilan. Ditinjau dari perspektif etika Islam dan maqasid syari„ah, praktik talak live lebih banyak menimbulkan dampak negatif karena berpotensi mencederai kehormatan, menimbulkan tekanan psikologis, serta mengganggu perlindungan terhadap keluarga. ABSTRACT The practice of live-streamed divorce on social media presents new problems in the realm of Islamic family law, particularly concerning its validity, ethics, and legal consequences. The focus of this research problem is the position of live-streamed divorce from a fiqh perspective and its assessment according to positive law and maqasid syari‟ah. This research aims to examine the validity of livestreamed divorce while analyzing its implications from an ethical perspective and the protection of human values. The method used is a literature study with a normative juridical approach through a review of classical and contemporary fiqh literature, legal doctrine, court decisions, and various related scientific sources. The research findings indicate that from a fiqh perspective, live-streamed divorce can be considered valid if it meets the pillars and requirements, such as being carried out by a husband who is mature, sane, conscious, and uses a clear wording or is accompanied by intention. However, in a positive legal system, divorce only has legal force after a court decision. Viewed from the perspective of Islamic ethics and maqasid syari„ah, the practice of live divorce has more negative impacts because it has the potential to harm honor, cause psychological stress, and disrupt protection for the family.
