Abstract

ABSTRACT This study examines the practice of the ngikuk anak tradition in determining child custody after divorce within the indigenous community of Lampung Pesisir Marga Punduh and analyzes it from the perspective of Islamic family law. The research employs an empirical legal method with a qualitative approach. Data were collected through interviews with traditional leaders, religious figures, and community members involved in child-rearing practices, and were supported by a review of relevant literature on customary law and Islamic family law. The findings reveal that the ngikuk anak tradition is carried out through family deliberation involving parents, extended family members, and traditional leaders to determine the most suitable caregiver for the child after divorce. The decision is generally based on several considerations, including economic capability, readiness to care for the child, and the emotional relationship between the child and the prospective caregiver. In practice, child custody is not always granted to the biological parents but may also be entrusted to other family members, such as grandparents or close relatives, who are considered more capable of providing proper care. From the perspective of Islamic family law, this practice aligns with the concept of hadhanah, which emphasizes the protection and welfare of the child.
