Abstract

ABSTRAK Sistem proporsional terbuka di amanatkan dalam pasal 168 Ayat (2) Undang-undang Nomor 7 Tahun 2017 tentang pemilihan umum. Dalam tinjauan perspektif siyasah dusturiyah, yaitu kebijakan konstitusional yang menekankan keadilan dan musyawarah dalam pemilihan wakil rakyat. Permasalahan nya ialah mengenai kewenangan partai politik dalam penentuan calon anggota legislatif, pengaturan sistem proporsional terbuka diatur berdasarkan UU Nomor 7 Tahun 2017. Penilitian ini bertujuan untuk mengetahui kewenangan parpol dalam menentukan calon legislatif dan untuk mengetahui secara luas pengaturan sistem proporsional terbuka berdasarkan UU No. 7 Tahun 2017. Metode penelitian ini menggunakan jenis penelitian normatif yaitu dengan cara maneliti bahan pustaka seperti norma-norma hukum atau data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Berdasarkan hasil penelitian yaitu sistem proporsional terbuka menjadi sebuah sistem yang dijalankan dalam pemilihan umum, tetapi sistem ini masih banyak memikiki kekurangan, mulai dari biaya kampanye yang menjadi mahal, integritas calon dan pemilih dipertaruhkan dengan maraknya money politik, polarisasi politik, politik identitas, dan biaya yang dikeluarkan oleh negara terhitung cukup banyak. Walaupun pada kenyataannya sistem ini memberikan ruang luas kepada pemilih untuk memilih calon legislatif yang di kehendakinya, disarankan kepada Partai politik untuk menjalankan amanat demokrasi berdasarkan undang-undang partai politik dan DPR harus memperkuat dengan merevisi undang-undang partai politik dan undang-udang pemilu terhadap norma hukum maupun dampak pada sistem ketatanegaraan di Indonesia. ABSTRACT The open proportional system is mandated in Article 168 Paragraph (2) of Law Number 7 of 2017 concerning General Elections. Within the perspective of Siyasah Dusturiyah constitutional policy that emphasizes justice and deliberation (musyawarah) in the election of representatives the primary issue concerns the authority of political parties in determining legislative candidates. The regulation of the open proportional system is established based on Law No. 7 of 2017. This research aims to identify the authority of political parties in selecting legislative candidates and to comprehensively examine the arrangements of the open proportional system under Law No. 7 of 2017. This study employs a normative legal research method by examining library materials and secondary data, which include primary, secondary, and tertiary legal sources. The results indicate that while the open proportional system is the mechanism implemented in general elections, it still possesses numerous shortcomings. these include high campaign costs, the compromised integrity of both candidates and voters due to rampant money politics, political polarization, identity politics, and significant state expenditures. Despite the fact that this system provides voters with broad autonomy to choose their desired legislative candidates, it is recommended that political parties fulfill their democratic mandate as stipulated by the Law on Political Parties. Furthermore, the House of Representatives (DPR) must strengthen the legal framework by revising the Law on Political Parties and the Election Law, regarding both legal norms and their impact on the constitutional system in Indonesia.
