Abstract

ABSTRAK Perdagangan pakaian bekas (thrift shop) merupakan salah satu bentuk aktivitas ekonomi yang berkembang pesat di masyarakat perkotaan, termasuk di Kecamatan Sukarame Kota Bandar Lampung. Praktik jual beli pakaian bekas menawarkan alternatif kebutuhan sandang yang ekonomis, namun di sisi lain memiliki potensi permasalahan hukum, khususnya terkait kondisi barang yang tidak selalu sempurna dan adanya cacat tersembunyi. Oleh karena itu, sistem garansi menjadi aspek penting dalam melindungi hak konsumen. Dalam perspektif hukum ekonomi syariah, setiap transaksi jual beli harus dilaksanakan berdasarkan prinsip keadilan, kejujuran, transparansi, serta kejelasan akad agar terhindar dari unsur penipuan (tadlis) dan kerugian sepihak. Namun, dalam praktiknya, sistem garansi pada jual beli pakaian bekas sering kali diterapkan secara informal dan belum sepenuhnya sesuai dengan ketentuan hukum ekonomi Syariah. Berdasarkan latar belakang tersebut, rumusan masalah dalam penelitian ini adalah bagaimana mekanisme sistem garansi dalam jual beli pakaian bekas di Toko Kato Kecamatan Sukarame Kota Bandar Lampung dan bagaimana tinjauan hukum ekonomi syariah terhadap pelaksanaan sistem garansi tersebut. Adapun tujuan penelitian ini adalah untuk mengetahui dan menganalisis praktik sistem garansi yang diterapkan oleh Toko Kato serta menilai kesesuaiannya dengan prinsip-prinsip hukum ekonomi syariah, khususnya yang berkaitan dengan konsep dhamān, khiyār al-‘aib, keadilan, dan perlindungan konsumen dalam Islam. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian kualitatif dengan pendekatan yuridis-empiris dan bersifat deskriptifanalitis. Data diperoleh melalui observasi langsung terhadap praktik jual beli, wawancara dengan pemilik toko, karyawan, dan konsumen, serta dokumentasi yang berkaitan dengan kebijakan garansi. Data yang terkumpul dianalisis dengan mengaitkan temuan lapangan dengan teori dan prinsip hukum ekonomi syariah untuk menilai kesesuaian antara praktik sistem garansi dan ketentuan syariah yang berlaku. Hasil penelitian menunjukkan bahwa sistem garansi di Toko Kato diterapkan dalam bentuk penukaran barang dengan batas waktu tertentu, namun masih bersifat informal dan belum sepenuhnya memenuhi prinsip kejelasan akad, transparansi, serta perlindungan konsumen dalam hukum ekonomi syariah. Oleh karena itu, diperlukan perbaikan dalam penerapan sistem garansi agar lebih terstruktur dan sesuai dengan prinsip keadilan, kejujuran, serta konsep dhamān dan khiyār al-‘aib dalam Islam. ABSTRACT The secondhand clothing trade (thrift shops) is a rapidly growing economic activity in urban communities, including in Sukarame District, Bandar Lampung City. The practice of buying and selling secondhand clothing offers an economical alternative to clothing needs, but on the other hand, it carries the potential for legal issues, particularly related to the imperfect condition of goods and the presence of hidden defects. Therefore, a warranty system is a crucial aspect in protecting consumer rights. From the perspective of Sharia economic law, every sale and purchase transaction must be carried out based on the principles of fairness, honesty, transparency, and clarity of the contract to avoid fraud (tadlis) and unilateral losses. However, in practice, the warranty system in the sale of secondhand clothing is often implemented informally and does not fully comply with the provisions of Sharia economic law. Based on this background, the research problem is formulated to determine the warranty system mechanism in the sale of secondhand clothing at the Kato Shop, Sukarame District, Bandar Lampung City and how Sharia economic law views the implementation of this warranty system. The purpose of this study is to identify and analyze the warranty system practices implemented by Toko Kato and to assess its compliance with the principles of Islamic economic law, particularly those related to the concepts of dhamān, khiyār al-‘aib, justice, and consumer protection in Islam. The research method used in this study is qualitative research with a juridical-empirical approach and is descriptive-analytical. Data were obtained through direct observation of buying and selling practices, interviews with shop owners, employees, and consumers, and documentation related to the warranty policy. The collected data were analyzed by linking field findings with Islamic economic law theory and principles to assess the compliance of the warranty system practices with applicable Sharia provisions. The results indicate that the warranty system at Toko Kato, implemented in the form of an exchange of goods within a specified time limit, remains informal and does not fully comply with the principles of contract clarity, transparency, and consumer protection in Islamic economic law. Therefore, improvements are needed in the implementation of the warranty system to make it more structured and align with the principles of justice, honesty, and the concepts of dhamān and khiyār al-‘aib in Islam.
