Abstract

Penelitian ini bertujuan untuk menganalisis implementasi Pasal 31 dan Pasal 32 Peraturan Menteri Dalam Negeri Nomor 110 Tahun 2016 tentang Badan Permusyawaratan Desa (BPD) serta meninjaunya dalam perspektif Fiqh Siyasah Tanfidziyah. Pasal tersebut mengatur fungsi BPD dalam menampung dan menyalurkan aspirasi masyarakat, membahas serta menyepakati rancangan peraturan desa bersama kepala desa, serta melakukan pengawasan terhadap jalannya pemerintahan desa. Namun dalam praktiknya masih terdapat kesenjangan antara ketentuan normatif dengan realitas pelaksanaannya di lapangan. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan penelitian lapangan (field research) yang didukung oleh studi kepustakaan. Data diperoleh melalui observasi, wawancara dengan anggota BPD, pemerintah desa, serta masyarakat, dan dokumentasi yang berkaitan dengan pelaksanaan tugas BPD di Desa Sinar Banten Kecamatan Talang Padang Kabupaten Tanggamus. Hasil penelitian menunjukkan bahwa implementasi Pasal 31 dan 32 Permendagri Nomor 110 Tahun 2016 telah dilaksanakan oleh BPD Desa Sinar Banten melalui musyawarah desa, penyaluran aspirasi masyarakat, serta pengawasan terhadap pemerintahan desa. Namun pelaksanaannya belum optimal karena musyawarah belum dilaksanakan secara rutin dan partisipasi masyarakat dalam menyampaikan aspirasi melalui BPD masih rendah. Dalam perspektif Fiqh Siyasah Tanfidziyah, pelaksanaan fungsi BPD tersebut telah mencerminkan prinsip syura (musyawarah), keadilan, persamaan, kebebasan, dan amanah dalam penyelenggaraan pemerintahan desa.. Kata Kunci: Badan Permusyawaratan Desa, kelembagaan desa, Fiqh Siyasah Tanfidziyah.ABSTRACT This research aims to analyze the implementation of Articles 31 and 32 of the Regulation of the Minister of Home Affairs Number 110 of 2016 concerning the Village Consultative Body (BPD) and to examine it from the perspective of Fiqh Siyasah Tanfidziyah. These articles regulate the functions of the BPD in accommodating and channeling community aspirations, discussing and agreeing on draft village regulations together with the village head, and supervising the implementation of village governance. However, in practice there are still gaps between normative provisions and the reality of their implementation in the field. This study uses a qualitative research method with a field research approach supported by library research. The data were obtained through observation, interviews with members of the BPD, village government officials, and the community, as well as documentation related to the implementation of BPD duties in Sinar Banten Village, Talang Padang District, Tanggamus Regency. The results of the study indicate that the implementation of Articles 31 and 32 of the Regulation of the Minister of Home Affairs Number 110 of 2016 has been carried out by the BPD of Sinar Banten Village through village deliberation meetings, the distribution of community aspirations, and supervision of village governance. However, its implementation has not been optimal because deliberation meetings are not held regularly and community participation in conveying aspirations through the BPD remains low. From the perspective of Fiqh Siyasah Tanfidziyah, the implementation of the BPD’s functions reflects the principles of syura (deliberation), justice, equality, freedom, and trustworthiness in village governance.
