Abstract

ABSTRAK Peraturan Daerah Kabupaten Tanggamus Nomor 51 Tahun 2019 tentang Kabupaten penyelenggara Layak Anak (KLA) bertujuan menjamin terpenuhinya hak anak untuk hidup, tumbuh, berkembang, dan berpartisipasi secara optimal sesuai harkat serta martabat kemanusiaan. Meskipun demikian, masih ditemukan berbagai kasus kekerasan dan Bullying terhadap anak di Kabupaten Tanggamus yang bertentangan dengan prinsip-prinsip KLA sebagaimana diatur dalam Pasal 5, yaitu tata pemerintahan yang baik, kepentingan terbaik bagi anak, pemenuhan hak hidup dan tumbuh kembang, non-diskriminasi, serta penghargaan terhadap pendapat anak. Penelitian ini menggunakan metode kualitatif dengan pendekatan field research. Data dikumpulkan melalui wawancara dengan Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DP3A), Gugus Tugas KLA, ditunjang dengan dokumentasi literatur, peraturan, dan arsip terkait. Tujuan penelitian adalah mengetahui implementasi Pasal 5 Peraturan Daerah KLA Kabupaten Tanggamus serta menganalisisnya dari perspektif siyasah tanfidziyah. Hasil penelitian menunjukkan bahwa implementasi Pasal 5 telah berjalan melalui pembentukan Gugus Tugas, integrasi indikator KLA dalam kebijakan daerah, serta kolaborasi lintas sektor. Namun, hambatan masih ditemukan pada penanganan kasus kekerasan anak, keterbatasan sumber daya, dan rendahnya kesadaran masyarakat. Dari sudut pandang siyasah tanfidziyah, implementasi ini sejalan dengan prinsip pelaksanaan undang-undang dalam Islam, yaitu menghadirkan kemaslahatan dan melindungi hak anak sebagai amanah negara. ABSTRACT The Regional Regulation of Tanggamus Regency Number 51 of 2019 concerning the Regency that organizes the Suitable Child (KLA) aims to ensure the fulfillment of children's rights to live, grow, develop, and participate optimally according to the dignity and dignity of humanity. However, there are still various cases of violence and Bullying against children in Tanggamus Regency that are contrary to the principles of KLA as stipulated in Article 5, namely good governance, the best interests for children, the fulfillment of the right to life and growth and development, non-discrimination, and respect for children's opinions. This research uses a qualitative method with a field research approach. The data was collected through interviews with the Women's Empowerment and Child Protection Service (DP3A), the KLA Task Force, supported by literature documentation, regulations, and related archives. The purpose of the research is to know the implementation of Article 5 of the KLA Regional Regulation of Tanggamus Regency and analyze it from the perspective of the tanfidziyah community. The research results show that the implementation of Article 5 has been implemented through the establishment of Task Forces, the integration of KLA indicators in regional policies, and cross-sectoral collaboration. However, obstacles are still found in the handling of child abuse cases, limited resources, and low public awareness. From the point of view of siyasah tanfidziyah, this implementation is in line with the principle of implementing laws in Islam, which is to present benefits and protect children's rights as the trust of the state.
