Abstract
ABSTRAK Penelitian ini bertujuan untuk mengkaji praktik jual beli ular piton yang berlangsung di Desa Jaya Tinggi, Kecamatan Kasui, Kabupaten Way Kanan, ditinjau dari perspektif hukum ekonomi syariah. Topik ini menjadi penting untuk ditelaah karena berkaitan dengan aspek kehalalan, kemanfaatan, serta dampak sosial dan ekologis dari praktik tersebut. Jual beli hewan yang tidak umum dikonsumsi, seperti ular piton, menimbulkan pertanyaan mengenai kesesuaiannya dengan prinsip-prinsip dasar dalam syariah. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif-analitis. Data diperoleh melalui wawancara mendalam dengan pelaku usaha, tokoh masyarakat, dan pihak terkait lainnya, serta melalui studi pustaka terhadap sumber-sumber hukum Islam yang relevan. Hasil penelitian menunjukkan bahwa praktik jual beli ular piton di daerah tersebut dilatarbelakangi oleh faktor ekonomi dan kebiasaan lokal. Namun demikian, praktik ini menyimpan potensi ketidaksesuaian dengan prinsip hukum ekonomi syariah, terutama terkait dengan status kehalalan objek jual beli dan prinsip kemaslahatan. Dalam tinjauan hukum ekonomi syariah, objek jual beli harus memenuhi kriteria kehalalan, memberikan manfaat nyata, dan tidak menimbulkan mudarat. Oleh karena itu, praktik jual beli ular piton memerlukan peninjauan lebih lanjut dari segi manfaat ekonominya, dampaknya terhadap keseimbangan ekosistem, serta kesesuaiannya dengan hukum positif yang berlaku di Indonesia. Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan wacana hukum ekonomi syariah di sektor perdagangan lokal dan menjadi rujukan bagi masyarakat maupun pembuat kebijakan dalam merumuskan regulasi yang sejalan dengan nilai-nilai syariah. ABSTRACT This research aims to examine the practice of buying and selling pythons in Jaya Tinggi Village, Kasui District, Way Kanan Regency, from the perspective of Islamic economic law. This topic is important to examine because it relates to the aspects of halal (permissible), utilitarianism, and the social and ecological impacts of the practice. The buying and selling of animals not commonly consumed, such as pythons, raises questions regarding its compliance with basic principles of Sharia. This research used a qualitative approach with descriptiveanalytical methods. Data were obtained through in-depth interviews with business actors, community leaders, and other relevant parties, as well as through a literature review of relevant Islamic legal sources. The results indicate that the practice of buying and selling pythons in the area is motivated by economic factors and local customs. However, this practice has the potential to be inconsistent with the principles of Islamic economic law, particularly regarding the halal status of the object of sale and the principle of benefit. From a Sharia economic law perspective, the object of sale must meet the criteria of halal (permissible), provide tangible benefits, and not cause harm. Therefore, the practice of buying and selling pythons requires further examination in terms of its economic benefits, impact on ecosystem balance, and compliance with applicable positive law in Indonesia. This research is expected to contribute to the development of discourse on Sharia economic law in the local trade sector and serve as a reference for the public and policymakers in formulating regulations that align with Sharia values.
