Abstract

ABSTRAK Hak Asasi Manusia menjamin bahwa setiap warga negara, termasuk Orang Dengan Gangguan Jiwa (ODGJ), berhak memperoleh perlindungan, pelayanan, serta pemenuhan hak secara layak tanpa diskriminasi dalam bentuk apa pun. ODGJ sebagai bagian dari penyandang disabilitas memiliki kedudukan hukum yang sama di hadapan negara. Dalam perspektif hukum, disabilitas secara umum terbagi menjadi tiga golongan, yaitu disabilitas fisik (keterbatasan pada fungsi tubuh), disabilitas intelektual (keterbatasan fungsi pikir dan adaptasi), serta disabilitas mental atau psikososial yang mencakup gangguan jiwa. Namun demikian, pelanggaran hak seperti penelantaran, pengucilan, dan kurangnya akses layanan kesehatan mental masih terjadi di Kota Bandar Lampung. Penelitian ini bertujuan menganalisis pelaksanaan pemenuhan hak ODGJ oleh Dinas Sosial berdasarkan Peraturan Daerah Kota Bandar Lampung Nomor 4 Tahun 2024. Melalui pendekatan kualitatif, ditemukan bahwa Dinas Sosial berperan aktif dalam penjangkauan lapangan, asesmen kesehatan awal, rujukan medis ke fasilitas kesehatan, serta rehabilitasi sosial melalui yayasan mitra pemerintah. ODGJ tanpa identitas menjadi tanggung jawab penuh pemerintah daerah dengan dukungan anggaran. Kendala utama meliputi kurangnya sosialisasi, lemahnya koordinasi antarlembaga, serta minimnya kesadaran dan keterlibatan keluarga pasien dalam proses pemulihan. ABSTRACT Human Rights guarantee that every citizen, including People with Mental Disorders (ODGJ), has the right to receive adequate protection, services and fulfillment of rights without discrimination in any form. ODGJ as persons with disabilities have the same legal status before the state. From a legal perspective, disabilities are generally divided into three groups, namely physical disabilities (limitations in bodily functions), intellectual disabilities (limitations in thinking and adaptation functions), and mental or psychosocial disabilities which include mental disorders. However, rights violations such as neglect, exclusion and lack of access to mental health services still occur in Bandar Lampung City. This research aims to analyze the implementation of fulfilling the rights of ODGJ by the Social Service based on Bandar Lampung City Regional Regulation Number 4 of 2024. Through a qualitative approach, it was found that the Social Service plays an active role in field outreach, initial health assessments, medical referrals to health facilities, and social rehabilitation through government partner foundations. ODGJ without identity is the full responsibility of the local government with budget support. The main obstacles include a lack of socialization, weak coordination between institutions, and minimal awareness and involvement of the patient's family in the recovery process.
