Abstract

ABSTRAK Dalam Undang-Undang Nomor 6 tahun 2014 pasal 61, BPD merupakan lembaga perwujudan demokrasi dalam penyelenggaran Pemerintah Desa yang berfungsi menampung dan menyalurkan aspirasi masyarakat. Didalam fiqh Syasyah kedudukan Badan Permusyawaratan Desa sama dengan lembaga Ahlu al-ahlli wa al-„aqdi. Para ahli fiqh siya>sah merumuskan pengertian Ahlu al-ahlli wa al-„aqdi sebagai orang yang memiliki kewenangan untuk memutuskan dan menentukan sesuatu atas nama umat (warga negara). Berdasarkan hal tersebut rumusan masalah dalam penelitian ini adalah bagaimana implementasi pasal 14 ayat (1) di dalam proses pemilihan BPD, dan bagaimana tinjauan fiqh Syasyah terhadap implementasi pasal 14 ayat (1). Jenis penelitian ini adalah penelitian lapangan (field research), dan Sifat penelitian ini menggunakan metode kualitatif dengan teknik pengumpulan data melalui wawancara, dan dokumentasi. Informan penelitian terdiri dari Ketua BPD, Sekertaris Desa. Hasil penelitian menunjukkan bahwa implementasi Pasal 14 Ayat (1) sudah sesuai dengan pasal yang berlaku. Sebelum adanya pemilihan BPD telah disepakati oleh Kepala Desa dan panitia pembentuk BPD untuk setiap dusun diperbolehkan mencalokan 5 (lima) orang calon untuk dusun I, 4 (empat) orang calon untuk dusun II,III,dan dusun IV, sehingga akan terkumpul 17 orang calon anggota BPD dari 4 dusun yang ada di wilayah Desa Sumberejo. Dari ke 17 nama calon yang telah di ajukan kepada panitia pembentuk BPD, akan melalui tahap penyaringan oleh panitia pembentuk BPD Desa Sumberejo dengan memperhatikan Syarat-Syarat yang telah di buat dan disepakati sebelumnya, dari hasil penelitian yang penulis teliti dari ke 17 calon tersebut ada perempuan yang mencalonkan diri didalam bursa pencalonan dan sudah terpilih sebagai anggota. Sudah sesuai menurut Peraturan Dearah Kabuparen Lampung Timur No 08 Tahun 2016 pada pasal 14 ayat (1) yaitu jumlah anggota Badan Permusyawaratan Desa ditetapkan dengan jumlah gasal, paling sedikit 5 (lima) orang dan paling banyak 9 (sembilan) orang, dengan memperhatikan wilayah, perempuan, penduduk, dan kemampuan keuangan Desa.Pemilihan anggota BPD Desa Sumberejo belum sepenuhnya menjalankan aturan yang telah dibuat khususnya untuk jumlah ganjil pada anggota BPD, pada kenyataannya di Desa Sumberejo hanya memiliki 8 orang anggota BPD. ABSTRACT In Law Number 6 of 2014 Article 61, the Village Consultative Body (BPD) is defined as an institution embodying democracy in the administration of village governance, functioning to accommodate and channel the aspirations of the community. In fiqh siya>sah, the position of the Village Consultative Body is equivalent to the institution of Ahl al-ḥall wa al-‘aqd. Scholars of fiqh Syasyah formulate Ahl al-ḥall wa al-‘aqd as individuals who possess the authority to decide and determine matters on behalf of the people (citizens). Based on this, the research questions in this study are: how is the implementation of Article 14 paragraph (1) in the process of electing BPD members, and how does fiqh Syasyah view the implementation of Article 14 paragraph (1)? This research is a field study (field research) with a qualitative approach. Data collection techniques include interviews and documentation. The research informants consist of the Chairperson of the BPD and the Village Secretary. The results of the study indicate that the implementation of Article 14 paragraph (1) has generally been in accordance with the applicable regulation. Prior to the BPD election, it was agreed by the Village Head and the BPD formation committee that each hamlet could nominate candidates as follows: five (5) candidates from Hamlet I, and four (4) candidates each from Hamlets II, III, and IV, resulting in a total of 17 candidates from the four hamlets within Sumberejo Village. Of the 17 nominated candidates submitted to the BPD formation committee, they underwent a screening process conducted by the committee, taking into account the previously established and agreed-upon requirements. Based on the research findings, among the 17 candidates there was a woman who nominated herself and was successfully elected as a member. This is in accordance with East Lampung Regency Regulation Number 08 of 2016 Article 14 paragraph (1), which stipulates that the number of BPD members must be odd, with a minimum of five (5) and a maximum of nine (9) members, taking into consideration regional representation, women’s representation, population, and the village’s financial capacity.However, the election of BPD members in Sumberejo Village has not fully complied with the established regulations, particularly regarding the requirement for an odd number of members. In practice, Sumberejo Village currently has only eight (8) BPD members.
