Abstract

ABSTRAK Pemerintah Kabupaten Lampung Barat telah menetapkan Peraturan Daerah Nomor 1 Tahun 2017 tentang Kawasan Tanpa Rokok. Penetapan kawasan tanpa rokok ini bertujuan untuk melindungi masyarakat dari paparan asap rokok serta menciptakan lingkungan yang bersih dan sehat. Puskesmas Kenali merupakan salah satu tempat yang ditetapkan sebagai area kawasan tanpa rokok namun masih ditemukan masyarakat tidak menaati aturan yang sudah ditetapkan dengan melakukan aktivitas merokok dilingkungan Puskesmas Kenali. Rumusan masalah dalam penelitian ini adalah Bagaimana Implementasi Pasal 11 Ayat (1) Peraturan Daerah Kabupaten Lampung Barat Nomor 1 Tahun 2017 Tentang Kawasan Tanpa Rokok di Puskesmas Kenali Kecamatan Belalau Kabupaten Lampung Barat dan Bagaimana Tinjauan Fiqh Siyāsah Terhadap Implementasi Pasal 11 Ayat (1) Peraturan Daerah Kabupaten Lampung Barat Nomor 1 Tahun 2017 Tentang Kawasan Tanpa Rokok di Puskesmas Kenali Kecamatan Belalau. Penelitian ini menggunakan teori Fiqh Siyāsah yaitu ilmu yang membahas aturan-aturan syariat Islam yang berkaitan dengan pengaturan urusan masyarakat dan pemerintahan untuk mencapai kemaslahatan. Fiqh Siyāsah dalam penelitian ini berfokus pada Siyāsah Tanfidżiyah (Politik Pelaksanaan perundang- undangan). Jenis penelitian ini adalah penelitian lapangan (field research) dengan sifat penelitian yaitu deskriptif. Metode pengumpulan data dalam penelitian ini dengan cara observasi, wawancara dan dokumentasi. Berdasarkan hasil penelitian implementasi kebijakan kawasan tanpa rokok di Puskesmas Kenali Kecamatan Belalau Kabupaten Lampung Barat telah berjalan namun belum sepenuhnya efektif. Puskesmas Kenali telah melaksanakan kebijakan kawasan tanpa rokok dengan memasang tanda larangan merokok seperti banner, stiker, dan tanda peringatan lainnya, akan tetapi dalam pelaksanannya masih ditemukan pelanggaran berupa pengunjung yang merokok di lingkungan Puskesmas Kenali. Faktor-faktor yang menjadi hambatan dalam implementasi pasal 11 ayat (1) peraturan daerah Kabupaten Lampung Barat nomor 1 tahun 2017 tentang kawasan tanpa rokok di Puskesmas Kenali antara lain yaitu kurangnya kesadaran masyarakat, sosialisasi yang belum merata, kurangnya pengawasan, serta belum adanya penegakan sanksi yang tegas sehingga kebijakan tersebut belum optimal. Tinjauan Fiqh Siyāsah terhadap Implementasi Pasal 11 Ayat (1) Peraturan Daerah Kabupaten Lampung Barat nomor 1 tahun 2017 tentang kawasan tanpa rokok di Puskesmas Kenali menunjukkan bahwa kebijakan tersebut sudah sesuai dengan prinsip Fiqh Siyāsah karena kebijakan tersebut dibuat untuk mewujudkan kemaslahatan bersama yaitu tujuannya untuk melindungi masyarakat dari bahaya yang ditimbulkan oleh asap rokok. Namun demikian dalam implementasinya kebijakan tersebut belum sepenuhnya mencerminkan Siyāsah Tanfidżiyah. ABSTRACT The West Lampung Regency Government has established Regional Regulation Number 1 of 2017 concerning Smoke-Free Areas. The establishment of these smoke-free areas aims to protect the public from exposure to cigarette smoke and create a clean and healthy environment. Kenali Community Health Center is one of the places designated as a smokefree area, but people are still found not complying with the established rules by smoking within the Kenali Community Health Center environment. The problem formulation in this study is How is the Implementation of Article 11 Paragraph (1) of West Lampung Regency Regional Regulation Number 1 of 2017 concerning Smoke-Free Areas at Kenali Community Health Center, Belalau District, West Lampung Regency and How is the Fiqh Siyāsah Review of the Implementation of Article 11 Paragraph (1) of West Lampung Regency Regional Regulation Number 1 of 2017 concerning Smoke-Free Areas at Kenali Community Health Center, Belalau District. This study uses the theory of Islamic jurisprudence (fiqh siyāsah), a science that discusses the rules of Islamic law related to the regulation of social and governmental affairs to achieve public welfare. This study focuses on the political implementation of legislation (siyāsah tanfidżiyah). This study is a field research with a descriptive nature. Data collection methods used are observation, interviews, and documentation. Based on the results of the research, the implementation of the smokefree area policy at the Kenali Community Health Center, Belalau District, West Lampung Regency has been running but has not been fully effective. The Kenali Community Health Center has implemented the smoke-free area policy by installing smoking prohibition signs such as banners, stickers, and other warning signs, however, in its implementation, violations were still found in the form of visitors smoking in the Kenali Community Health Center environment. Factors that are obstacles in the implementation of Article 11 paragraph (1) of the West Lampung Regency regional regulation number 1 of 2017 concerning the smoke-free area at the Kenali Community Health Center include lack of public awareness, uneven socialization, lack of supervision, and the absence of strict enforcement of sanctions so that the policy is not optimal. The Fiqh Siyāsah Review of the Implementation of Article 11 Paragraph (1) of the West Lampung Regency Regional Regulation Number 1 of 2017 concerning smoke-free areas at the Kenali Community Health Center shows that the policy is in accordance with the principles of Fiqh Siyāsah because the policy was made for the benefit of humanity, namely its aim is to protect the community from the dangers caused by cigarette smoke and to realize the common good. However, in its implementation, the policy does not fully reflect Siyāsah Tanfidżiyah.
