Abstract

ABSTRAK Perseroan terbatas ialah entitas hukum yang beroperasi di tengahtengah kehidupan warga, sehingga kehadirannya idealnya menyediakan manfaat timbal balik, baik bagi bisnis usaha itu sendiri maupun bagi warga di sekitarnya. Dalam upaya mewujudkan keseimbangan tersebut, negara telah menetapkan peraturan dalam Pasal 74 ayat (1) UU No. 40 Tahun 2007 mengenai Perseroan Terbatas, yang mewajibkan setiap perseroan yang bergerak di bidang atau berkaitan dengan pemanfaatan sumber daya alam untuk menerapkan tanggung jawab sosial dan lingkungan (TJSL). Meskipun demikian, implementasi regulasi ini sering kali diterapkan sebatas pemenuhan formalitas hukum semata, tanpa diiringi komitmen yang serius untuk mewujudkan tujuan utama dari penerapan TJSL tersebut. Padahal, setiap berupa aktivitas tanggung jawab sosial dan lingkungan seharusnya dilaksanakan secara optimal agar memperoleh menyediakan efek positif yang optimal dan tidak berakhir sia-sia. Secara normatif, penerapan tanggung jawab sosial dalam UndangUndang tersebut mencerminkan strategi pemerintah untuk mengembangkan kesejahteraan warga melalui keterlibatan aktif dunia usaha dalam pembangunan sosial dan lingkungan secara berkelanjutan. Melalui pendekatan pengumpulan data berbasis penelitian lapangan, memperoleh dipahami bahwasannya hukum Islam mempunyai peran penting dalam menyeimbangkan antara hak dan keharusan demi terciptanya kemaslahatan bagi umat manusia. Dalam konteks ini, keberadaan fiqh siyasah tanfidziyyah berfungsi sebagai landasan normatif yang menjamin agar setiap peraturan yang diambil, baik oleh perseroan terbatas maupun oleh pemerintah, dilaksanakan secara tepat dan proporsional guna mewujudkan kesejahteraan warga secara menyeluruh. ABSTRACT Limited liability companies operate within the fabric of society and, therefore, their presence should ideally generate mutual benefits for both the corporation and the surrounding community. In pursuit of this objective, Article 74(1) of Law No. 40 of 2007 on Limited Liability Companies mandates that companies engaged in sectors related to natural resources are obligated to fulfill their social and environmental responsibilities. However, in practice, the implementation of this law is often limited to a formal compliance effort, lacking substantive action to achieve its intended purpose. Such responsibilities should be carried out earnestly to ensure that the intended social and environmental outcomes are effectively realized and not rendered ineffective or meaningless. The implementation of social responsibility in Law Number 40 of 2007 is a government effort to improve the standard of living of the community with regulations that should be implemented by the limited liability company. With data collection techniques through field research. Islamic law regulates between rights and obligations for the welfare of humanity with the existence of Fiqh siyasah tanfidziyyah, it can ensure that the policies implemented by limited liability companies and the government are truly appropriatein order to achieve the welfare of society.
