Abstract

ABSTRAK Penelitian ini secara mendalam menganalisis praktik khiyar dalam transaksi jual beli handphone melalui platform Shopee, dengan fokus khusus pada akun Nana.shopp, dari perspektif Hukum Ekonomi Syariah. Pendekatan kualitatif deskriptif analitis diterapkan melalui pengumpulan data primer berupa wawancara mendalam dengan 1 orang penjual dan 10 orang pembeli terpilih menggunakan purposive sampling serta dokumentasi berupa review, chat, dan foto barang dari platform Shopee, dilengkapi data sekunder dari literatur fiqh muamalah, Al-Quran, Hadis, dan jurnal terkait. Hasil penelitian mengungkap bahwa praktik khiyar didominasi oleh khiyar aib akibat ketidaksesuaian spesifikasi handphone seperti baterai rusak, layar cacat, atau kondisi tidak sesuai deskripsi, meskipun proses retur sering terhambat oleh penolakan penjual dan prosedur platform yang rumit. Secara hukum syariah, praktik ini sebagian besar sesuai dengan prinsip khiyar untuk mencegah penyesalan dan kerugian pasca-akad sebagaimana diatur dalam fiqh muamalah, tetapi menyimpang ketika sighat ijab-qabul tidak eksplisit menyebut hak khiyar atau terdapat unsur gharar akibat kurangnya transparansi. Temuan ini menegaskan perlunya integrasi klausul syariah dalam e-commerce, edukasi konsumen tentang hak muamalah digital, dan penguatan mediasi berbasis fatwa untuk mewujudkan kemaslahatan transaksi yang adil bagi penjual dan pembeli. ABSTRACT This study provides an in-depth analysis of the practice of khiyār in mobile phone buying and selling transactions conducted through the Shopee platform, with a specific focus on the account Nana.shopp, from the perspective of Islamic economic law. A qualitative descriptive–analytical approach was employed by collecting primary data through in-depth interviews with 1 seller and 10 selected buyers using purposive sampling, as well as documentation in the form of reviews, chats, and product photos from the Shopee platform. These were complemented by secondary data derived from fiqh muʿāmalah literature, the Qur‟an, Hadith, and relevant academic journals. The findings reveal that the practice of khiyār is predominantly characterized by khiyār al-ʿayb (option due to defects), arising from discrepancies in mobile phone specifications such as damaged batteries, defective screens, or conditions that do not match the product descriptions. However, the return process is often hindered by seller rejection and complex platform procedures. From the perspective of Islamic law, these practices largely conform to the principles of khiyār aimed at preventing regret and post-contractual losses as regulated in fiqh muʿāmalah. Nevertheless, deviations occur when the ṣīghah of ijāb–qabūl does not explicitly mention khiyār rights or when elements of gharar arise due to a lack of transparency. These findings highlight the need for the integration of shariacompliant clauses within e-commerce platforms, enhanced consumer education regarding digital muʿāmalah rights, and the strengthening of mediation mechanisms based on fatwas to realize fair and beneficial transactions for both sellers and buyers.
