Abstract

ABSTRAK Fenomena kehamilan di luar nikah yang melibatkan orang tua dibawah umur menimbulkan kompleksitas hukum, sosial, dan moral, terutama dalam hal pemberian nafkah kepada anak yang lahir dari hubungan tersebut. Isu ini menjadi penting mengingat anak luar nikah merupakan kelompok rentan yang berhak atas perlindungan hukum, termasuk pemenuhan kebutuhan hidupnya. Penelitian ini menggunakan metode yuridis komparatif dengan membandingkan pengaturan tanggung jawab nafkah anak luar nikah dalam perspektif hukum islam dan peaturan perundang-undangan di Indonesia. Hasil penelitian menunjukkan bahwa dalam hukum islam, tanggung jawab nafkah anak luar nikah secara normatif dibebankan kepada ibu karena tidak adanya hubungan nasab dengan ayah biologis. Sementara itu, dalam hukum positif Indonesia melalui Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, anak luar nikah memiliki hubungan perdata dengan ayah biologisnya sepanjang dapat dibuktikan secara ilmiah, termasuk kewajiban pemberian nafkah. Oleh karena itu, diperlukan penguatan regulasi dan harmonisasi hukum agar pemenuhan hak anak luar nikah tetap terjamin secara adil dan berorientasi pada kepentingan terbaik bagi anak. ABSTRACT The phenomenon of out-of-wedlock pregnancies involving underage parents creates complex legal, social, and moral issues, particularly regarding the provision of financial support for children born from such relationships. This issue is significant because children born out of wedlock constitute a vulnerable group entitled to legal protection, including the fulfillment of their basic needs, while underage parents do not yet possess full legal capacity. This study employs a juridical comparative research method by comparing the regulation of financial responsibility for children born out of wedlock from the perspective of Islamic law and Indonesian statutory law. The findings indicate that under Islamic law, the obligation to provide financial support for children born out of wedlock is normatively borne by the mother due to the absence of a legally recognized lineage (nasab) with the biological father. Meanwhile, under Indonesian positive law, particularly through Constitutional Court Decision No. 46/PUU-VIII/2010, children born out of wedlock may have a civil relationship with their biological father based on scientific evidence, which includes the obligation to provide financial support. Therefore, strengthening regulations and harmonizing legal norms are necessary to ensure the protection of children’s rights based on the best interests of the child.
