Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis Implementasi Pasal 19 Ayat (2) Peraturan Dearah Kota Bandar Lampung Nomor 14 Tahun 2023 Tentang Penyediaan Dan Pengelolaan Ruang Terbuka Hijau oleh Dinas Lingkungan Hidup Kota Bandar Lampung, khususnya terkait permasalahan penyediaan dan pengelolaan ruang terbuka hijau RTH (Ruang Terbuka Hijau) yang ada di Kelurahan Way Dadi Baru. Penggusuran dan pengalihfungsian RTH ini menjadi salah satu faktor utama yang menyebabkan banyak dampak negatif bagi masyarkat Kelurahan Way Dadi Baru. Penelitian ini dilatarbelakangi oleh ketidak efektifan peenyediaan dan pengelolaan ruang terbuka hijau RTH, sehingga menimbulkan keresahan masyarakat di Kelurahan Way Dadi Baru. Berdasarkan permasalahan yang tertuang diatas, penulis bertujuan untuk mengkaji Bagaimana Implementasi Terhadap Pasal 19 ayat (2) Peraturan Kota Bandar Lampung Nomor 14 tahun 2023 Tentang Penyediaan dan Pengeloaan Ruang Terbuka Hijau di Dinas Lingkungan Hidup Kota Bandar Lampung?, Bagaimana Tinjauan Siyāsah Tanfidziyah Terhadap Implementasi Pasal 19 Ayat (2) Peraturan Daerah Kota Bandar Lampung Nomor 14 Tahun 2023 Tentang Penyediaan dan Pengelolaan Ruang Terbuka Hijau di Dinas Lingkungan Hidup Kota Bandar Lampung? Metode penelitian yang digunakan adalah penelitian lapangan (field research) dengan sifat deskriptif kualitatif. Data diperoleh melalui observasi, wawancara, dokumentasi, serta studi literatur dari sumber-sumber yang relevan. Penelitian ini juga menganalisis implementasi kebijakan tersebut dari perspektif Fiqh Siyasah Tanfidziyah, yang menekankan prinsip sidiq (kejujuran), amanah (kepercayaan), fathanah (kecerdasan), dan tabligh (komunikasi). Hasil penelitian menunjukan bahwa penyediaan dan pengelolaan ruang terbuka hijau di kelurahan Way Dadi Baru terjadi penggusuran dan pengalih fungsian lahan yang mengakibatkan dampaknegatif bagi masyarakat yang bertentangan dengan pasal 19 ayat (2) Peraturan Daerah Kota Banda Lampung No 14 Tahun 2023 tentang penyediaan dan pengelolaan ruang terbuka hijau, karena adanya kesenjangan antara peraturan dan pelaksanaan di lapangan tidak terlaksana dengan baik. Persepektif Fiqh Siyasah Tanfidziyyah, Hal yang dilaksanakan pemerintah dalam persoalan ini tidak dalam aspek amanah (menjaga kepercayaan publik) dan tabligh (menyampaikan dan menjelaskan kebijakn secara terbuka dan benar) dalam mencegah kerusakan lingkungan hidup dan menjaga keberlangsungan fungsi Ruang Terbuka Hijau yang menjadi tugas pemerintah. Penelitian ini merekomendasikan langkah serius dan konkret dari Dinas Lingkungan Hidup Kota Bandar Lampung untuk mengimplementasikan aturan dengan konsisten dan melakukan rehabilitas pada Ruang Terbuka Hijau yang sudah digusur. ABSTRACT This study aims to analyze the implementation of Article 19 Paragraph (2) of Bandar Lampung City Regulation Number 14 of 2023 concerning the Provision and Management of Green Open Spaces by the Bandar Lampung City Environment Agency, particularly in relation to issues surrounding the provision and management of green open spaces (RTH) in Way Dadi Baru Village. The eviction and conversion of these green open spaces have become one of the main factors causing many negative impacts on the community of Way Dadi Baru Village. This study was motivated by the ineffectiveness of the provision and management of green open spaces, which has caused unrest among the community in Way Dadi Baru Village. Based on the issues outlined above, the author aims to examine the implementation of Article 19 paragraph (2) of Bandar Lampung City Regulation Number 14 of 2023 concerning the Provision and Management of Green Open Spaces in the Bandar Lampung City Environment Agency. How does Siyāsah Tanfidziyah review the implementation of Article 19 paragraph (2) of Bandar Lampung City Regulation Number 14 of 2023 concerning the Provision and Management of Green Open Spaces in the Bandar Lampung City Environment Agency? The research method used is field research with a descriptive qualitative nature. Data is obtained through observation, interviews, documentation, and literature studies from relevant sources. This study also analyzes the implementation of the policy from the perspective of Fiqh Siyasah Tanfidziyah, which emphasizes the principles of sidiq (honesty), amanah (trust), fathanah (intelligence), and tabligh (communication). The results of the study show that the provision and management of green open spaces in Way Dadi Baru sub-district has led to evictions and land conversion, which has had a negative impact on the community and is contrary to Article 19 paragraph (2) of Banda Lampung City Regulation No. 14 of 2023 concerning the provision and management of green open spaces, because there is a gap between the regulations and their implementation in the field, which is not being carried out properly. From the perspective of Fiqh Siyasah Tanfidziyyah, what the government has done in this matter is not in line with the aspects of amanah (maintaining public trust) and tabligh (communicating and explaining policies openly and correctly) in preventing environmental damage and maintaining the sustainability of green open spaces, which is the government's responsibility. This study recommends serious and concrete steps by the Bandar Lampung City Environment Agency to consistently implement regulations and rehabilitate Green Open Spaces that have been cleared.
