Abstract

ABSTRAK Latar belakang penelitian ini adalah Alih fungsi Taman Hutan Kota Way Halim Bandar Lampung menjadi area rencana pembangunan perumahan dan ruko (superblok). Hilangnya Taman Hutan. Kontroversi pembangunan Superblok di eks Taman Hutan Kota Way Halim, pihak perusahaan pengembang yaitu PT Hasil Karya Kita Bersama (HKKB) ternyata belum memiliki izin analisa dampak lingkungan (AMDAL). Rumusan dan adanya penelitian ini adalah , Bagaimana Analisis Implementasi Pasal 9 Ayat 3 huruf o Peraturan Wali Kota Bandar Lampung Nomor 50 Tahun 2021 Tentang Susunan Organisasi, Tugas dan Fungsi Serta Tata Kerja Dinas Lingkungan Hidup Kota Bandar Lampung di Dinas Lingkungan Hidup Kota Bandar Lampung? Bagaimana Analisis Siyāsah Tanfīẓiyyah Terhadap Implementasi Pasal 9 Ayat 3 huruf o Peraturan Wali Kota Bandar Lampung Nomor 50 Tahun 2021 Tentang Susunan Organisasi, Tugas dan Fungsi Serta Tata Kerja Dinas Lingkungan Hidup Kota Bandar Lampung di Dinas Lingkungan Hidup Kota Bandar Lampung? teori yang digunakan yaitu Siyāsah Tanfīẓiyyah serta teori-teori yang berkaitan dengan lingkungan hidup. Penelitian ini menggunakan metode kualitatif deskriptif untuk menggambarkan dan menganalisis fenomena secara mendalam. Hasil penelitian ini menunjukkan bahwa pertama, untuk koordinasi Penyusunan Mengenai AMDAL yaitu sudah terlaksana karena Bidang Tata Lingkungan Hidup DLH Kota Bandar Lampung sudah mengeluarkan surat rekomendasi Kelayakan Lingkungan untuk AMDAL di Eks Taman Hutan Kota Way Halim Wilayah Bagian Kelurahan Way Dadi dan Masyarakat sekitar wilayah Eks Taman Hutan Kota Way Halim sudah terkena dampak pembagunan, seperti banjir, suhu menjadi panas, dan drainase yang kurang baik. Kedua, implementasi dari Koordinasi Penyusunan Mengenai AMDAL sudah sesuai dengan kaidah dalam fiqh siyasah yaitu upaya yang dilakukan oleh pemerintah Kota Bandar Lampung adalah untuk terpenuhinya hak Lingkungan baik dan nyaman masyarakat khususnya Wilayah Eks Taman Hutan Kota Way Halim dan Pejabat Penelaah Teknis Kebijakan di Bidang Tata Lingkungan Kota Bandar Lampung termasuk ke dalam Wizarah AlTanfiz. Kesimpulannya yaitu bahwasannya kewenangan izin AMDAL untuk wilayah Eks Taman Hutan Kota Way Halim (Way Dadi) adalah kewenangan DLH Kota Bandar Lampung dan PT. Hak Karya Kita Bersama saat ini sudah mendapatkan izin AMDAL-nya sedangkan untuk wilayah Eks Taman Hutan Kota Way Halim (Way Halim Permai) adalah kewenangan DLH Provinsi Lampung dan Implementasi Pasal 9 Ayat (3) huruf o Peraturan Wali Kota Bandar Lampung Nomor 50 Tahun 2021 Tentang Susunan Organisasi, Tugas dan Fungsi Serta Tata Kerja Dinas Lingkungan Hidup Kota Bandar Lampung di eks Taman Hutan Kota Way Halim baik dalam kajian teorinya maupun dalam konteks pelaksanaannya sudah sesuai Siyasah Tanfiziyah. ABSTRACT The background of this research was the conversion of the Way Halim City Forest Park in Bandar Lampung into a planned area for housing and commercial buildings (superblock). According to the Indonesian Forum for the Environment, the loss of the City Forest Park would have negatively impacted environmental sustainability and public health. The controversy surrounding the construction of the superblock in the former City Forest Park of Way Halim revealed that the developer, PT Hasil Karya Kita Bersama (HKKB), had not yet obtained the Environmental Impact Assessment (AMDAL) permit. This research applied the theory of Siyāsah Tanfīẓiyyah and theories related to environmental issues using a qualitative descriptive method. The data sources used were both primary and secondary data. The findings of the study showed, first, that the coordination of AMDAL preparation had been implemented, as the Environmental Structuring Division of the Environmental Office (DLH) of Bandar Lampung City had issued a recommendation letter regarding the environmental feasibility of the AMDAL for the former City Forest Park area located in Way Dadi Subdistrict. Furthermore, the surrounding communities had already experienced the impacts of the development, such as flooding, increased temperatures, and inadequate drainage. Second, the implementation of the coordination in AMDAL preparation had been in accordance with the principles of fiqh siyasah, in which the efforts made by the Bandar Lampung City Government aimed to fulfill the right to a good and healthy environment for the community, especially those living in the former Way Halim City Forest Park area. The Technical Policy Review Officer in the Environmental Structuring Division of Bandar Lampung City was included in the category of Wizarah al-Tanfiz. In conclusion, the authority to grant AMDAL permits for the former City Forest Park area in Way Dadi fell under the jurisdiction of the DLH of Bandar Lampung City, and PT Hasil Karya Kita Bersama had already obtained its AMDAL permit. Meanwhile, the area of Way Halim Permai fell under the authority of the Provincial Environmental Office of Lampung. The implementation of Article 9 Paragraph (3) letter o of Mayor Regulation No. 50 of 2021 concerning the Organizational Structure, Duties, Functions, and Work Procedures of the Environmental Office of Bandar Lampung City in the context of the former Way Halim City Forest Park, both in theoretical review and practical execution, had aligned with Siyasah Tanfiziyah.
