Abstract

ABSTRAK Fenomena dari aktivitas merokok saat berkendara yang terjadi pada saat ini sangat merugikan dan dapat membahayakan pengendara lain. Sehingga pemerintah Kota Metro membuat kebijakan yang bertujuan untuk memberikan manfaat kepada masyarakat Kota Metro. Sehingga, larangan merokok ini juga bertujuan agar pengendara tetap berkonsentrasi saat berkendara. Supaya, tidak membahayakan orang lain maupun dirinya. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan Peraturan Menteri Nomor 12 Tahun 2019 Pasal 6 Ayat C tentang larangan merokok saat mengendarai kendaraan bermotor di Unit Laka Lantas Polres Kota Metro dan untuk mengetahui tinjauan siyāsah tanfiżiyyah terhadap peraturan menteri perhubungan nomor 12 tahun 2019 pasal 6 ayat c tentang larangan merokok saat mengendarai kendaraan bermotor di Unit Laka Lantas Polres Kota Metro. Penelitian ini termasuk penelitian lapangan (field research), yaitu penelitian yang datanya diperoleh langsung dari Unit Laka Lantas Polres Kota Metro. Pengumpulan data dilakukan secara kualitatif yaitu dengan melalui pengamatan (observasi), wawancara, dan menelaah dokumen. Pengolahan data dilakukan melalui tahap editing dan sistematis data. Sedangkan sifat penelitian deskriptif analisis, yaitu menganalisis apa yang saat ini berlaku atau gambaran mengenai realita, sifat-sifat serta hubungan fenomena yang diselidiki. Kesimpulan dari penelitian ini terhadap implementasi Peraturan menteri Perhubungan Nomor 12 Tahun 2019 Pasal 6 Ayat C di Unit Laka Lantas Polres Kota Metro telah dilakukan melalui sosialisasi, himbauan, dan sanksi edukatif untuk meningkatkan kesadaran hukum masyarakat. Namun, tingkat kepedulian masyarakat terhadap bahaya merokok saat berkendara masih rendah, meskipun mayoritas responden mengetahui adanya larangan tersebut. Dalam perspektif Fiqh siyāsah tanfiżiyyah, aturan larangan merokok saat berkendara sejalan dengan prinsip hukum Islam karena bertujuan menciptakan kemaslahatan dan keselamatan masyarakat. Kepatuhan terhadap peraturan menteri perhubungan ini merupakan bagian dari upaya menjaga keteraturan sosial sesuai dengan nilai-nilai syariat Islam. The purpose of this research is to find out the implementation of Ministerial Regulation Number 12 of 2019 Article 6 Paragraph C regarding the prohibition of smoking while driving a motor vehicle in the Metro City Police Laka Lantas Unit and to find out the Fiqh siyāsah tanfiżiyyah review of ministerial regulation number 12 of 2019 article 6 paragraph c regarding the prohibition of smoking while driving a motor vehicle in the Metro City Police Laka Lantas Unit. This research includes field research, namely research whose data is obtained directly from the Metro City Police Traffic Offense Unit. Data collection was conducted qualitatively, namely through observation, interviews, and reviewing documents. Data processing is done through the editing and systematic stages of data. While the nature of the research is descriptive analysis, namely analyzing what is currently happening or a description of the reality, properties and relationships of the phenomena being investigated. The conclusion of this research on the implementation of the Minister of Transportation Regulation Number 12 of 2019 Article 6 Paragraph C in the Metro City Police Traffic Unit has been carried out through socialization, appeals, and educational sanctions to increase public legal awareness. However, the level of public awareness of the dangers of smoking while driving is still low, even though the majority of respondents are aware of the ban. In the perspective of Fiqh siyāsah tanfiżiyyah, the regulation on the prohibition of smoking while driving is in line with the principles of Islamic law because it aims to create public benefit and safety. Compliance with this regulation is part of an effort to maintain social order in accordance with the values of Islamic law.
