Abstract

ABSTRAK Penelitian ini mengkaji perspektif madzhab Syafi’i dan Hanafi dalam melihat poligami serta bagaimana pandangan tersebut tercermin dalam hukum keluarga di tiga negara: Indonesia, Turki, dan Mesir. Ketiganya merupakan negara dengan mayoritas penduduk Muslim namun memiliki pendekatan hukum yang berbeda terhadap praktik poligami, yang dipengaruhi oleh madzhab fikih, konteks sejarah, dan kebijakan negara modern. Permasalahan dalam penelitian ini adalah (a) Bagaimana perbandingan ketentuan poligami dalam perundang-undangan hukum keluarga di Indonesia, Turki dan Mesir? (b) Bagaimana ketentuan poligami dalam pembaruan hukum keluarga Indonesia, Turki dan Mesir dibandingkan perspektif madzhab Syafi’i dan Hanafi. Penelitian ini bertujuan untuk memahami kesesuaian atau pergeseran antara teori fikih klasik dan praktik hukum positif kontemporer dalam persoalan poligami. Jenis penelitian ini merupakan penelitian normatif dengan pendekatan kualitatif yang bersifat deskriptif analisis. Penelitian ini menggunakan metode studi pustaka dan pendekatan komparatif. Hasil penelitian menunjukkan bahwa mazhab Syafi’i dan Hanafi sama-sama membolehkan poligami dengan syarat keadilan dan membatasi jumlah istri 4 orang, namun penerapannya sangat bervariasi. Di Indonesia, yang secara historis terpengaruh mazhab Syafi’i, poligami dibolehkan namun diatur ketat melalui izin pengadilan. Turki, meskipun berakar dari mazhab Hanafi, secara hukum melarang poligami sebagai bagian dari reformasi hukum modern. Sementara itu, Mesir, yang juga bermazhab Hanafi, masih membolehkan poligami namun memberikan perlindungan hak-hak perempuan melalui regulasi administratif. Penelitian ini menyimpulkan bahwa perbandingan hukum keluarga di ketiga negara mencerminkan bagaimana pandangan fikih klasik dapat mengalami reinterpretasi atau pembatasan dalam kerangka negara hukum modern yang mempertimbangkan keadilan sosial dan kesetaraan gender. ABSTRACT This research examines the perspectives of the Shafi’i and Hanafi schools regarding polygamy, and how these perspectives are reflected in the family law systems of three countries: Indonesia, Turkey, and Egypt. Although all three are Muslim-majority countries, they adopt different legal approaches to the practice of polygamy, influenced by jurisprudential traditions, historical context, and modern state policy. The research addresses two main questions: (a) How do the legal provisions on polygamy compare in the family law regulations of Indonesia, Turkey, and Egypt? (b) How do the provisions on polygamy in the reformed family laws of these countries align with or diverge from the classical views of the Shafi’i and Hanafi schools? The study aims to explore the compatibility or shift between classical fiqh theory and contemporary positive law in the issue of polygamy. This study employs a normative legal research method using a qualitative approach, with a descriptive-analytical and comparative nature. The research relies on library-based data collection and comparative legal analysis. The findings indicate that both the Shafi’i and Hanafi schools permit polygamy with the condition of justice and a limit of four wives. However, implementation varies greatly. In Indonesia, which is historically influenced by the Shafi’i school, polygamy is legally permitted but strictly regulated through court approval. Turkey, although rooted in Hanafi tradition, legally prohibits polygamy as part of its modern legal reforms. Meanwhile, Egypt, which also adheres to the Hanafi school, continues to allow polygamy but provides protections for women’s rights through administrative regulations. The study concludes that the comparison of family law across the three countries illustrates how classical Islamic jurisprudence can undergo reinterpretation or restriction within the framework of modern legal systems that emphasize social justice and gender equality.
