Abstract

ABSTRAK Peraturan Daerah Provinsi Lampung Pasal 7 Nomor 7 Tahun 2011 tentang penyelenggaraan kesejahteraan sosial bagi penyandang disabilitas berkaitan dengan hak aksesibilitas di sarana umum memang telah memberikan dasar hukum yang penting bagi pemenuhan hak-hak penyandang disabilitas. Namun, dalam kenyataannya, implementasi dari peraturan ini masih jauh dari harapan. Sebagaimana disebutkan, fasilitas yang disediakan pemerintah baru mencakup beberapa tempat seperti lingkungan kampus, bandara, dan rumah sakit. Rumusan masalah dalam penelitian ini adalah tentang bagaimana implementasi pasal 7 peraturan daerah provinsi lampung nomor 7 tahun 2021 tentang penyelengaraan kesejahteraan sosial bagi penyandang disabilitas berkaitan dengan hak aksesibilitas di sarana umum dan Bagaimana tinjauan siyãsah tanfîžiyyah terhadap peran pemerintah provinsi Lampung dalam pemenuhan hak aksesibilitas di sarana umum bagi penyandang disabilitas yang belum optimal. Tujuan penelitian ini adalah untuk mengetahui tinjauan siyãsah tanfîžiyyah terhadap implementasi pasal 7 peraturan daerah provinsi lampung nomor 7 tahun 2021 tentang penyelengaraan kesejahteraan sosial bagi penyandang disabilitas berkaitan dengan hak aksesibilitas di sarana umum. Penelitian ini termasuk penelitian kepustakaan (library research). Data sekunder diperoleh dari buku-buku peraturan perundang-undangan dan jurnal. Pengelolaan data dilakukan dengan cara pemeriksaan data dan sistematisasi data analisa data dilakukan dengan cara analisis deskriptif. Berdasarkan hasil penelitian dan pembahasan maka dapat diketahui bahwa implementasi pasal 7 peraturan daerah provinsi lampung nomor 7 tahun 2021 tentang penyelengaraan kesejahteraan sosial bagi penyandang disabilitas berkaitan dengan hak aksesibilitas di sarana umum sebenarnya sudah direalisasikan sebagai salah satu prioritas utama. seperti pembangunan fasilitas umum yang dilengkapi dengan jalur khusus penyandang disabilitas, pemasangan lift dengan fitur aksesibilitas, serta penyediaan layanan informasi dalam format braille atau bahasa isyarat belum sepenuhnya optimal. Implementasi pasal 7 peraturan daerah provinsi lampung nomor 7 tahun 2021 belum sesuai dengan tuntutan siyãsah tanfîžiyyah, karena fasilitas di sarana umum yang diperuntukkan bagi penyandang disabilitas, seperti belum tersedianya halte, eskalator di mall, dan fasilitas jalan di sekolahsekolah, pelabuhan, dan kampus-kampus belum sepenuhnya optimal dan merata di seluruh daerah Provinsi Lampung. Sesuai dengan Q.S An-nur ayat 61 bahwa penyandang disabilitas tidak boleh didiskriminasi dan harus diperlakukan sama. Islam menekankan pentingnya berlaku adil terhadap semua orang, termasuk penyandang disabilitas. Keadilan ini mencakup perlakuan yang sama tanpa memandang perbedaan fisik atau status sosial. ABSTRACT Regional Regulation of Lampung Province Article 7 Number 7 of 2011 concerning the implementation of social welfare for persons with disabilities, particularly regarding accessibility rights in public facilities, has indeed provided a crucial legal foundation for the fulfillment of the rights of persons with disabilities. However, in practice, the implementation of this regulation is still far from expectations. As mentioned, the facilities provided by the government currently only cover a few places, such as university environments, airports, and hospitals. The research problem formulated in this study is: How is the implementation of Article 7 of Regional Regulation of Lampung Province Number 7 of 2021 concerning the implementation of social welfare for persons with disabilities in relation to accessibility rights in public facilities? And how is the review of Siyãsah Tanfîžiyyah on the role of the Lampung Provincial Government in fulfilling accessibility rights in public facilities for persons with disabilities that has not yet been optimized? The purpose of this research is to examine the Siyãsah Tanfîžiyyah perspective on the implementation of Article 7 of Regional Regulation of Lampung Province Number 7 of 2021 concerning the implementation of social welfare for persons with disabilities, particularly in relation to accessibility rights in public facilities. This study is a library research. Secondary data were obtained from books, laws and regulations, and journals. Data management was carried out through data examination and systematization, while data analysis was conducted using descriptive analysis. Based on the results and discussion, it is found that the implementation of Article 7 of Regional Regulation of Lampung Province Number 7 of 2021 has actually been realized as one of the main priorities, such as the construction of public facilities equipped with special lanes for persons with disabilities, installation of elevators with accessibility features, and the provision of information services in braille or sign language formats. However, these implementations are still not fully optimal. The implementation has not yet aligned with the principles of Siyasah Tanfidziyah, as facilities in public areas designated for persons with disabilities—such as bus stops, escalators in malls, and accessible pathways in schools, ports, and university campuses—are still not fully optimal or evenly distributed across all regions of Lampung Province. In accordance with Q.S. An-Nur verse 61, persons with disabilities must not be discriminated against and should be treated equally. Islam emphasizes the importance of justice for all individuals, including those with disabilities. This justice includes equal treatment regardless of physical differences or social status.
