Abstract

ABSTRAK Petshop Bebo Kotabumi Lampung Utara yaitu toko menyediakan berbagai keperluan hewan seperti makanan, assesoris, kandang, dan dibidang jasa toko ini juga menyediakan kucing pejantan untuk dijual spermanya melalui transksi yang bisa disebut pacak/ mengkawinkan kucing. Permasalahan terjadi ketika kucing tersebut dikawinkan secara alami, yaitu dengan mencampurkan antara kucing betina dan kucing pejantan ke dalam satu kandang. Karena hasil dari proses terjadinya pembuahan ke dalam sel telur pada kucing betina tidak bisa dipastikan. Berdasarkan latar belakang di atas maka peneliti tertarik untuk melakukan penelitian tentang “Tinjauan Hukum Ekonomi Syariah Terhadap Sewa Menyewa Kucing Jantan (Studi di Petshop Bebo Kotabumi Lampung Utara).” Rumusan maslaah dalam penelitian ini adalah bagaimana praktik sewa menyewa kucing jantan di Petshop Bebo Kotabumi Lampung Utara? Dan bagaimana tinjauan hukum ekonomi syariah terhadap praktik sewa menyewa kucing jantan di Petshop Bebo Kotabumi Lampung Utara? Penelitian ini termasuk penelitian lapangan (field research) dan bersifat deskriptif. Informan dalam penelitian adalah 7 orang yakni 1 orang pemilik, 1 orang karyawan, dan 5 orang pelanggan Petshop Bebo Kotabumi Lampung Utara. Teknik pengumpulan data dengan wawancara, observasi, dan dokumentasi. Teknik analisa data dengan menggunakan reduksi data, data display, dan penarikan kesimpulan. Hasil penelitian mengemukakan bahwa praktik sewa menyewa kucing jantan di Petshop Bebo secara lisan berdasarkan kepercayaan para pihak. Objek perjanjian sewa menyewa adalah kucing pejantan unggul. Masa sewa 1 minggu dengan harga berkisar Rp. 500.000 dengan syarat kucing betina harus berumur satu tahun, sudah divaksin, kucing sudah benar-benar birahi, kucing harus bersih, tidak jamuran dan sehat. Apabila belum terjadi pembuahan pembeli dapat kembali lagi ke Petsop Bebo. Tinjauan hukum ekonomi syariah terhadap praktik sewa menyewa kucing jantan di Petshop Bebo adalah haram. Hal tersebut dikarenakan menurut pendapat Imam Syafi’i dan Hambali mengenai hukum jual beli sperma hewan pejantan ini, mereka berpendapat bahwa sewa-menyewa ini tidak dapat diketahui kadarnya, lagi pula tidak dapat diterima berapa kadar air mani tersebut. Praktik sewa menyewa kucing jantan tidak sah karena berdasarkan objek akad yang tidak bisa diserahterimakan atau tidak bisa diukur. ABSTRACT Bebo Petshop, Kotabumi, North Lampung, is a shop that provides various animal needs such as food, accessories, and cages. In its service sector, the shop also provides male cats for sale through a transaction known as "pacak" (cat mating). Problems arise when these cats are mated naturally, by mixing female and male cats in the same cage. This is because the outcome of the fertilization process into the female cat's egg is uncertain. Based on the above background, the researcher is interested in conducting a study entitled "A Review of Sharia Economic Law on the Leasing of Male Cats (A Study at Bebo Petshop, Kotabumi, North Lampung)." The research problem is formulated as follows: How is the practice of leasing male cats at Bebo Petshop, Kotabumi, North Lampung? And what is the Sharia economic law review of the practice of leasing male cats at Bebo Petshop, Kotabumi, North Lampung? This research is field research and is descriptive in nature. The informants in this study were 7 people: 1 owner, 1 employee, and 5 customers of Petshop Bebo Kotabumi, North Lampung. Data collection techniques included interviews, observation, and documentation. Data analysis techniques included data reduction, data display, and conclusion drawing. This research is field research and is descriptive in nature. The informants in the study were seven people: one owner, one employee, and five customers of Petshop Bebo, Kotabumi, North Lampung. The research findings suggest that the practice of renting male cats at Petshop Bebo is based on mutual trust. The object of the rental agreement is a superior male cat. The rental period is one week, with a price ranging from Rp 500,000. The condition is that the female cat must be one year old, vaccinated, fully in heat, clean, free of fungus, and healthy. If fertilization does not occur, the buyer can return to Petshop Bebo. The Sharia economic law review of the practice of renting male cats at Petshop Bebo is haram. This is because, according to the opinions of Imam Shafi'i and Hambali regarding the legality of buying and selling male animal sperm, they argue that the quantity of semen cannot be determined, and the semen content is unacceptable. The practice of renting male cats is invalid because it is based on a contract that cannot be transferred or measured.
