Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis mekanisme pencegahan dan penanganan pemilih ganda pada pemilihan umum sebagaimana di atur dalam Pasal 20 Ayat (1) Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum pada Bawaslu Provinsi Lampung melalui perspektif Siyāsah Tanfiżiyyah. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif, data diperoleh melalui wawancara mendalam dengan anggota Bawaslu Provinsi Lampung, serta ditunjang oleh studi dokumen terhadap regulasi perundang-undangan yang relevan. Temuan penelitian menunjukkan bahwa mekanisme yang dijalankan telah mencerminkan prinsip-prinsip fundamental Siyāsah Tanfiżiyyah, khususnya konsep keadilan (al-'adl), amanah, dan kemaslahatan (maslahah) dalam pengelolaan daftar pemilih. Implementasi prinsip hisbah sebagai sistem pengawasan berkelanjutan telah dimanifestasikan melalui koordinasi struktural dan partisipasi masyarakat dalam verifikasi data. Namun, efektivitas mekanisme masih terkendala oleh limitasi sumber daya manusia, akses terbatas terhadap data kependudukan, dan partisipasi masyarakat yang belum optimal. Perspektif Siyāsah Tanfiżiyyah memberikan legitimasi normatif yang memperkuat landasan etik-moral dalam pengawasan pemilu, sekaligus meningkatkan akseptabilitas sistem demokrasi di tengah masyarakat Indonesia yang mayoritas beragama Islam. Penelitian ini merekomendasikan penguatan kapasitas institusional, optimalisasi sistem integrasi data berbasis teknologi, dan reformulasi regulasi yang lebih adaptif untuk meningkatkan efektivitas pencegahan dan penanganan pemilih ganda dalam konteks pemilu kontemporer. ABSTRACT This study aims to analyze the mechanisms for preventing and handling double voting in general elections as stipulated in Article 20 Paragraph (1) of Law Number 7 of 2017 concerning General Elections at the Lampung Provincial Election Supervisory Agency (Bawaslu) through the perspective of Siyāsah Tanfiżiyyah. This study employs a legal-empirical method with a qualitative approach, with data collected through in-depth interviews with members of the Lampung Province Election Supervisory Board (Bawaslu), supplemented by a document review of relevant regulations. The research findings indicate that the mechanisms implemented have reflected the fundamental principles of Siyāsah Tanfiżiyyah, particularly the concepts of justice (al-'adl), trustworthiness, and public interest (maslahah) in the management of the voter list. The implementation of the principle of hisbah as a continuous oversight system has been manifested through structural coordination and community participation in data verification. However, the effectiveness of the mechanism is still constrained by limitations in human resources, limited access to population data, and suboptimal community participation. The perspective of Siyāsah Tanfiżiyyah provides normative legitimacy that strengthens the ethical-moral foundation of election oversight, while also increasing the acceptability of the democratic system among the majority Muslim population in Indonesia. This study recommends strengthening institutional capacity, optimizing technology-based data integration systems, and reformulating regulations to be more adaptive in order to enhance the effectiveness of preventing and addressing duplicate voters in the context of contemporary elections.
