Abstract

ABSTRAK Praktik jual beli akun game Mobile Legends melalui media sosial Facebook, khususnya di Grup Mobile Legend Bandar Lampung, yang rentan terhadap penipuan dan kerugian pihak pembeli. Dalam praktiknya, tidak jarang terjadi pengembalian dana atau Refund akibat penjual memberikan informasi akun yang tidak sesuai atau melakukan tindakan curang pasca transaksi. Hal ini memunculkan urgensi untuk meninjau kesesuaian sistem Refund dalam transaksi tersebut berdasarkan perspektif hukum ekonomi syariah. Rumusan masalah dalam penelitian ini adalah Bagaimana sistem Refund dalam jual beli akun Mobile Legends di Facebook dan Bagaimana tinjauan hukum ekonomi syariah terhadap sistem Refund tersebut Penelitian ini bertujuan untuk mengetahui praktik sistem Refund yang terjadi dalam transaksi tersebut dan mengevaluasinya melalui prinsip-prinsip hukum ekonomi syariah seperti kejujuran (sidq), keadilan („adl), serta larangan terhadap penipuan (gharar) dan ketidakjelasan (jahalah).Metode penelitian yang digunakan adalah metode kualitatif deskriptif dengan pendekatan lapangan (field research). Teknik pengumpulan data dilakukan melalui observasi langsung pada grup Facebook, wawancara dengan tiga informan (admin, penjual, dan pembeli), serta dokumentasi literatur hukum Islam dan hukum ekonomi syariah. Analisis data dilakukan secara deskriptif analitis dengan menafsirkan praktik yang terjadi berdasarkan dalil-dalil syar'i dan teori ekonomi syariah kontemporer. Hasil penelitian menunjukkan bahwa sistem Refund dalam jual beli akun Mobile Legends seringkali dilakukan secara informal dan tidak memiliki jaminan perlindungan hukum yang kuat. Penjual dan pembeli biasanya sepakat untuk melakukan pengembalian dana jika akun yang dijual tidak sesuai, namun pelaksanaannya sangat tergantung pada kepercayaan pribadi. Dalam perspektif hukum ekonomi syariah, praktik tersebut dapat dibenarkan sejauh memenuhi prinsip kerelaan, transparansi, dan tidak mengandung unsur penipuan . Dengan demikian, sistem Refund dapat menjadi solusi keadilan dalam jual beli akun game selama memenuhi syarat sah akad dan dilandasi oleh prinsip khiyar dan tanggung jawab moral kedua belah pihak. Kata Kunci: Hukum Ekonomi Syariah, Sistem Refund, Mobile Legends. iii ABSTRACK The practice of buying and selling Mobile Legends game accounts through social media, particularly in the Mobile Legends Bandar Lampung Facebook group, is vulnerable to fraud and financial loss for buyers. In practice, it is not uncommon for Refunds to occur due to sellers providing inaccurate account information or engaging in fraudulent actions after the transaction. This highlights the urgency of reviewing the appropriateness of the Refund system in such transactions from the perspective of Islamic economic law. The research questions in this study are How does the Refund system work in the buying and selling of Mobile Legends accounts on Facebook and What is the Islamic economic law perspective on this Refund system?This study aims to understand the actual practice of the Refund system in such transactions and evaluate it through the principles of Islamic economic law, such as honesty (ṣidq), justice („adl), and the prohibition of fraud (gharar) and uncertainty (jahālah).The research method used is descriptive qualitative with a field research approach. Data collection techniques include direct observation of the Facebook group, interviews with three informants (an admin, a seller, and a buyer), as well as documentation from Islamic law and Islamic economic law literature. The data were analyzed descriptively and analytically by interpreting the observed practices based on shar„i evidence and contemporary Islamic economic theories. The findings of the study indicate that the Refund system in the sale of Mobile Legends accounts is often carried out informally and lacks strong legal protection. Sellers and buyers usually agree to a Refund if the account sold does not match the description, but its implementation heavily depends on personal trust. From the perspective of Islamic economic law, this practice can be considered permissible as long as it meets the principles of mutual consent, transparency, and is free from elements of fraud.Therefore, the Refund system can serve as a just solution in the sale of game accounts, provided that it fulfills the conditions of a valid contract (akad) and is based on the principles of khiyār (the option to cancel) and the moral responsibility of both parties.
