Abstract

ABSTRAK Manusia sebagai makhluk sosial cenderung hidup berkelompok dan bekerja sama, termasuk dalam bidang ekonomi. Dalam Islam, kerja sama difasilitasi melalui akad yang sah seperti syirkah, yaitu kolaborasi usaha dengan prinsip saling menguntungkan. Di Way Jepara, Lampung Timur, kerja sama syirkah terjadi antara pemilik konter dan teknisi handphone, di mana pemilik menyediakan tempat dan sparepart, sedangkan teknisi menyumbang alat service. Keuntungan dibagi 40% untuk pemilik dan 60% untuk teknisi, tanpa gaji tetap, berdasarkan jumlah handphone yang diperbaiki tiap bulan. Namun, muncul dugaan teknisi tidak jujur dalam pelaporan harga sparepart yang mendapat potongan, sehingga memperoleh keuntungan pribadi tanpa sepengetahuan pemilik. Jenis penelitian ini adalah penelitian kualitatif. Yaitu penelitian yang bersifat deskriptif analisis. yang bertujuan untuk menggambarkan dan menganalisis fakta-fakta di lapangan berdasarkan perspektif hukum ekonomi syariah. Data dikumpulkan melalui wawancara, serta melalui dokumentasi yang relevan. Penelitian ini termasuk penelitian lapangan (field research). Sumber data berasal dari data primer yang diperoleh melalui wawancara, observasi dan dokumentasi sedangkan data sekunder berasal dari literatur yang terkait dengan penelitian. Hasil penelitian bahwa praktik kerja sama antar pemilik konter dengan teknisi handphone di Konter Barra Cell dilakukan dengan akad secara lisan dan tanpa adanya saksi hanya didasari kepercayaan kedua belah pihak. Dalam hal ini adanya ketidaksesuaian dalam praktik kerja sama, kerja sama antar pemilik konter dan teknisi handphone sama sama mengeluarkan modal tetapi pembagian hasil tidak sama rata. Dan pelaksanaan dilapangan menunjukan adanya penyimpangan dari teknisi yang tidak jujur dalam melaporkan potongan harga sparepart dan menetapkan harga diluar kesepakatan awal. Hal ini melanggar prinsip amanah dan keterbukaan dalam akad, yang dapat merugikan salah satu pihak. Kerja sama ini tidak sesuai dengan hukum Ekonomi Syariah dikarenakan teknisi handphone melakukan indikasi mencari keuntungan di atas akad yang telah disepakati yang menyebabkan akan merugikan salah satu pihak. Hal ini melanggar prinsip-prinsip dasar syirkah, tidak adanya akad tertulis dan tanpa saksi, adanya unsur ketidak jujuran (gharar), Oleh karna itu, kerja sama ini belum sepenuhnya sesuai dengan ketentuan hukum Ekonomi Syariah. ABSTRACT Humans, as social beings, tend to live in groups and collaborate, including in economic activities. In Islam, economic cooperation is facilitated through legitimate contracts such as syirkah, a business partnership based on mutual benefit and compliance with Islamic principles. In Way Jepara, East Lampung, a syirkah-based partnership exists between a mobile phone shop owner and a technician, where the owner provides the premises and spare parts, while the technician contributes service tools. Profits are shared at a ratio of 40% for the owner and 60% for the technician, with no fixed salary, based on the number of phones repaired each month. However, there are indications that the technician may not be fully transparent in reporting discounted spare part prices, thereby gaining personal profit without the owner's knowledge. His research is a qualitative study, characterized by descriptive and analytical methods. It aims to describe and analyze field facts from the perspective of Islamic economic law. Data were collected through interviews and relevant documentation. This study is categorized as field research. The sources of data consist of primary data obtained through interviews, observations, and documentation, as well as secondary data derived from literature related to the research topic. The partnership practice between the owner of Barra Cell and the mobile phone technician is conducted through an oral agreement, without any written contract or the presence of witnesses. This agreement is solely based on mutual trust between both parties. However, the implementation of this partnership reveals several inconsistencies with the principles of Islamic business ethics. Although both parties contribute capital, the profit-sharing arrangement is not distributed equally. Furthermore, field findings indicate dishonest behavior from the technician, such as failing to report spare part discounts and setting service prices without adhering to the initial agreement. These actions violate the principles of amanah (trustworthiness) and transparency, which are fundamental in Islamic contractual agreements. This indicates that the technician is attempting to obtain personal gain beyond what was agreed upon, which potentially causes harm to the other party. Such practices contradict the essential principles of syirkah in Islamic law, particularly due to the absence of a written contract, the lack of witnesses, and the presence of gharar (uncertainty or dishonesty). Based on these findings, it can be concluded that the existing partnership has not fully complied with the legal and ethical guidelines established in Islamic jurisprudence. Therefore, it is necessary to restructure the partnership in accordance with Islamic principles to ensure justice, clarity, and mutual benefit.
