Abstract

ABSTRAK Pasal 25 Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 yang terjadi di Kelurahan Way Kandis belum dijalankan dengan baik dan efisien karena terdapat usaha yang belum menjalankan Pasal 25 ayat (1) disebutkan bahwa Setiap usaha dan/atau kegiatan yang wajib memiliki amdal atau UKL-UPL wajib memiliki izin lingkungan. Oleh karena itu, maka diperlukan pengkajian untuk memecahkan permasalahan ini supaya tidak menimbulkan dampak yang merugikan masyarakat. Rumusan masalah penelitian ini yaitu bagaimana implementasi Pasal 25 Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup di Kelurahan Way Kandis Kecamatan Tanjung Seneng Kota Bandar Lampung dan bagaimana analisis Siyāsah Tanfiżiyyah terhadap implementasi Pasal 25 Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup di Kelurahan Way Kandis Kecamatan Tanjung Seneng Kota Bandar Lampung. Metode penelitian ini yaitu penelitian lapangan (field research) dan bersifat deskriptif analisis. Data yang digunakan adalah data primer dan sekunder. Metode pengumpulan data dalam penelitian ini yaitu dengan cara observasi, interview (wawancara), dan dokumentasi. Data yang digunakan dalam penelitian ini adalah data primer yang diperoleh langsung dari hasil wawancara atau observasi dari masyarakat sekitar yang terkena dampak, data sekunder diperoleh dari buku-buku dan dokumen. Berdasarkan hasil penelitian bahwa impelementasi Pasal 25 Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup Di Kelurahan Way belum terlaksana dengan semestinya masih ada beberapa usaha ayam potong yang memiliki izin lingkungan tetapi dalam proses pengelolaan lingkungan dan pembuangan limbahnya tidak sesuai dengan semestinya, serta adanya usaha ayam potong yang belum memiliki izin lingkungan, hal ini disebabkan oleh kurangnya informasi terkait pengelolaan lingkungan hidup dan pembuangan limbah bagi usaha ayam potong di Kelurahan Way Kandis, serta informasi mengenai izin lingkungan yang harus diberikan kepada usaha-usaha wajib AMDAL dan UKL/UPL. Analisis Siyāsah Tanfiżiyyah terhadap implementasi Pasal 25 Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2020 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup Di Kelurahan Way Kandis belum sesuai karena masih ada pelaku usaha yang menyimpang dari semangat nilai-nilai ajaran Islam yang mengajarkan pentingnya menjaga lingkungan hidup. ABSTRACT Article 25 of Bandar Lampung City Regional Regulation Number 1 of 2020 which occurred in Way Kandis Village has not been implemented properly and efficiently because there are businesses that have not implemented Article 25 paragraph (1) which states that Every business and/or activity that is required to have an environmental impact analysis or UKL-UPL must have an environmental permit. Therefore, a study is needed to solve this problem so that it does not cause a detrimental impact on the community. The formulation of the problem in this research is how the implementation of Article 25 of Bandar Lampung City Regional Regulation Number 1 of 2020 concerning Environmental Protection and Management in Way Kandis Village, Tanjung Seneng District, Bandar Lampung City and how the Siyāsah Tanfiżiyyah analysis of the implementation of Article 25 of Bandar Lampung City Regional Regulation Number 1 of 2020 concerning Environmental Protection and Management in Way Kandis Village, Tanjung Seneng District, Bandar Lampung City. The research method is field research and is descriptive analysis. The data used are primary and secondary data. The data collection method in this study is by observation, interview, and documentation. The data used in this study is primary data obtained directly from interviews or observations from the affected community, secondary data is obtained from books and documents. Based on the results of the study that the implementation of Article 25 of the Regional Regulation of Bandar Lampung City Number 1 of 2020 concerning Environmental Protection and Management in Way Village has not been implemented properly, there are still several broiler chicken businesses that have environmental permits but in the process of environmental management and waste disposal are not in accordance with what is appropriate, as well as there are broiler chicken businesses that do not have environmental permits, this is caused by a lack of information related to environmental management and waste disposal for broiler chicken businesses in Way Kandis Village, as well as information regarding environmental permits that must be given to businesses that are required to AMDAL and UKL / UPL. The analysis of Siyāsah Tanfiżiyyah on the implementation of Article 25 of the Regional Regulation of Bandar Lampung City Number 1 of 2020 concerning Environmental Protection and Management in Way Kandis Village is not yet appropriate because there are still business actors who deviate from the spirit of Islamic teachings that teach the importance of protecting the environment.
