Abstract

ABSTRAK Janin merupakan salah satu jiwa yang memiliki hak-hak dasar yang wajib dilindungi, di antaranya hak untuk hidup, hak memperoleh nafkah berupa asupan nutrisi, serta hak untuk sehat. Namun, pemenuhan hak-hak tersebut sering kali terabaikan ketika janin berasal dari hubungan di luar nikah. Hal ini disebabkan oleh berbagai faktor, seperti depresi akibat tekanan psikologis, serta keterbatasan ekonomi yang menghambat pemenuhan gizi dan akses terhadap layanan kesehatan. Fenomena kehamilan akibat perzinaan juga ditemukan di Kecamatan Bukit Kemuning, Kabupaten Lampung Utara. Kemudian dilakukan penelitian terkait pemenuhan hak-hak janin hasil perzinaan dilokasi tersebut dengan rumusan 1) Bagaimana tinjauan maqāṣid al-syarī‘ah terhadap pemenuhan hak hak janin hasil perzinaan di Kecamatan Bukit Kemuning?. 2) Bagaimana tinjauan teori kesehatan Hendrik L. Blum terhadap pemenuhan hak janin hasil perzinaan di Kecamatan Bukit Kemuning?. Penelitian ini bertujuan untuk menganalisis pemenuhan hak janin hasil perzinaan ditinjau dari perspektif hukum Islam dan teori kesehatan. Penelitian ini menggunakan metode kualitatif yang bersifat lapangan. Pendekatan yang digunakan adalah kesehatan, yuridis, dan empiris. Teknik pengumpulan data diperoleh melalui observasi dan wawancara dengan informan yang berinisial SM, INF, M, dan PZ. Kemudian dari keluarga, tokoh masyarakat, dan tenaga medis. Teknik analisis data dilakukan dengan cara berfikir deduktif dengan menganalisis fakta di lapangan dan kemudian dianalisis dengan data literatur. Hasil penelitian menunjukkan bahwa dalam tinjauan teori maqāṣid al syarī‘ah, khususnya prinsip ḥifẓ al-nafs, telah diupayakan melalui penolakan terhadap aborsi, pemeliharaan kehamilan, serta dukungan keluarga dan coping mechanism. Meski stigma sosial masih menjadi hambatan, ibu hamil tetap menunjukkan ikhtiyār menjaga jiwa janin. Dan tinjauan kesehatan Hendrik L. Blum terhadap pemenuhan hak-hak janin hasil perzinaan di Kecamatan Bukit Kemuning telah diupayakan melalui pola hidup sehat ibu hamil, pemeriksaan rutin, dukungan keluarga, serta akses layanan kesehatan yang inklusif. Lingkungan fisik cukup mendukung, sementara tekanan sosial masih menjadi tantangan. Tidak ditemukan riwayat penyakit genetik yang membahayakan janin. hak janin hasil perzinaan di Kecamatan Bukit Kemuning dalam perspektif. Hal ini mencerminkan bahwa nilai-nilai perlindungan jiwa telah diimplementasikan, meskipun perlu penguatan sistemik agar lebih optimal dan berkelanjutan. Kata Kunci: Hak Janin Hasil Perzinaan, Kesehatan, dan Maqāṣid al Syarī‘ah, v ABSTRACT A fetus is a living being that holds fundamental rights that must be protected, including the right to life, the right to sustenance in the form of nutritional intake, and the right to health. However, the fulfillment of these rights is often neglected when the fetus is conceived out of wedlock. This neglect stems from various factors, such as depression caused by psychological pressure and economic limitations that hinder nutritional fulfillment and access to healthcare services. The phenomenon of pregnancy resulting from extramarital affairs has also been observed in Bukit Kemuning Subdistrict, North Lampung Regency. A study was therefore conducted to examine the fulfillment of the rights of fetuses conceived through such circumstances in this area, with the following research questions: (1) How does the concept of maqāṣid al-syarī‘ah view the fulfillment of these fetal rights in the same area? (2) How does Hendrik L. Blum’s health theory view the fulfillment of fetal rights resulting from extramarital affairs in Bukit Kemuning Subdistrict? This study aimed to analyze the fulfillment of the rights of fetuses conceived through extramarital relationships from the perspectives of Islamic law and health theory. The study employed a qualitative field research method. The approaches used included health, legal, and empirical perspectives. Data were collected through observation and interviews with informants identified by the initials SM, INF, M, and PZ, as well as with family members, community leaders, and medical personnel. Data analysis was conducted using deductive reasoning by examining field facts and then analyzing them with supporting literature. The findings of the study indicate that, from the perspective of maqāṣid al sharī‘ah, particularly the principles of ḥifẓ al-nafs (protection of life) and ḥifẓ al ‘aql (protection of intellect), efforts have been made through the rejection of abortion, the preservation of pregnancy, family support, and the use of coping mechanisms. Although social stigma remains a barrier, pregnant women continue to demonstrate ikhtiyār (conscious effort) in safeguarding the life of the fetus. Moreover, based on Hendrik L. Blum’s health theory, the fulfillment of the rights of fetuses conceived out of wedlock in Bukit Kemuning District has been pursued through healthy maternal lifestyles, regular prenatal check-ups, family support, and inclusive access to healthcare services. The physical environment is relatively supportive, while social pressure continues to pose a challenge. No hereditary diseases that could endanger the fetus were found. This reflects that the values of protecting both life and intellect have been implemented, although systemic strengthening is still needed to ensure more optimal and sustainable outcomes.
