Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis implementasi Pasal 27A Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik (ITE) oleh Polda Lampung dalam konteks perlindungan hak menyatakan pendapat sebagaimana dijamin Pasal 28E ayat (3) UUD NRI Tahun 1945. Pasal 27A menggantikan ketentuan sebelumnya dalam upaya memberikan kepastian hukum terhadap tindak pidana pencemaran nama baik secara elektronik dengan pendekatan delik aduan murni. Penelitian ini menggunakan pendekatan kualitatif deskriptif melalui observasi, dokumentasi, serta wawancara dengan pihak Subdit V Siber Ditreskrimsus Polda Lampung. Hasil penelitian menunjukkan bahwa penegakan hukum telah dijalankan sesuai prosedur, termasuk pelibatan ahli dan upaya mediasi. Namun, ditemukan beberapa persoalan, seperti kecenderungan penyelesaian melalui mediasi tanpa batasan substantif, dugaan penyalahgunaan pasal untuk kepentingan pribadi, serta kesulitan teknis dalam menangani pelaku yang menggunakan akun anonim. Hal ini menimbulkan kekhawatiran atas potensi kriminalisasi terhadap ekspresi yang sah. Ditinjau dari perspektif fiqh siyasah, implementasi Pasal 27A belum sepenuhnya mencerminkan prinsip keadilan, amanah, syura, dan kemaslahatan. Oleh karena itu, diperlukan reformulasi strategi implementasi agar penegakan hukum tetap menjamin keadilan substantif dan melindungi hak konstitusional warga negara. ABSTRACT This study aims to analyze the implementation of Article 27A of Law Number 1 of 2024 concerning Electronic Information and Transactions (ITE) by the Lampung Regional Police in relation to the protection of the right to freedom of expression as guaranteed by Article 28E paragraph (3) of the 1945 Constitution of the Republic of Indonesia. Article 27A replaces the previous provision and is intended to provide legal certainty regarding defamation offenses in digital spaces through the adoption of a pure complaint offense. This research employs a qualitative descriptive approach through observation, documentation, and in-depth interviews with personnel from SubDirectorate V of Cyber Crime, Directorate of Special Criminal Investigation, Lampung Police. The findings indicate that law enforcement procedures have been followed, including expert involvement and mediation efforts. However, several issues were identified, such as a tendency toward mediation without clear substantive boundaries, alleged misuse of the article for personal interests, and technical obstacles in handling anonymous accounts. These issues raise concerns about the potential criminalization of lawful expression.
