Abstract

ABSTRAK Mahar merupakan prioritas utama sekalipun tidak termasuk dalam kategori rukun nikah. Mahar juga merupakan salah satu hak mutlak (hak istri) akibat terjadinya pernikahan. Mahar hanya diberikan calon suami kepada calon istri, bukan kepada wanita lainnya atau siapapun walaupun sangat dekat dengannya. Orang lain tidak boleh menjamah apalagi menggunakannya, meskipun oleh suaminya sendiri, kecuali dengan ridha dan kerelaan si istri. Penelitian ini membahas pendapat Imam Syafi‟i tentang ketidaksesuaian mahar yang disebutkan dalam ijab qabul dengan apa yang diberikan suami kepada istri, dengan studi kasus di Desa Simpang Empat, Kecamatan Lengkiti, Kabupaten Ogan Komering Ulu adanya fenomena di masyarakat di mana mahar yang disebutkan saat akad nikah tidak sesuai dengan mahar yang benar-benar diberikan, baik karena faktor ekonomi, kesepakatan, maupun alasan teknis lainnya. Penelitian ini bertujuan untuk mengetahui praktik pemberian mahar yang tidak sesuai dengan ijab qabul serta menganalisis pandangan Imam Syafi‟i terhadap permasalahan tersebut. Metode yang digunakan dalam penelitian ini bersifat deskriptif, dan termasuk jenis penelitian lapangan (field research) yaitu penelitian yang dilakukan dalam kehidupan yang sebenarnya, sebagai metode untuk menemukan secara spesifik dan realis tentang apa yang sedang terjadi di tengah-tengah kehidupan masyarakat. Hasil penelitian menunjukkan bahwa praktik ketidaksesuaian mahar masih terjadi dan diterima secara sosial selama ada keridhaan dari kedua belah pihak. Namun, menurut Imam Syafi‟i, pernikahan tetap sah meskipun terjadi ketidaksesuaian mahar, tetapi suami tetap berkewajiban melunasi kekurangan mahar sesuai dengan yang disebutkan dalam akad, kecuali istri merelakan kekurangan tersebut secara jelas. ABSTRACT Mahar (dowry) is considered a primary priority, even though it is not categorized as one of the pillars (rukun) of marriage. Mahar is also an absolute right (the wife‟s right) that arises as a result of marriage. It is given solely by the prospective husband to the prospective wife, not to any other woman or person, regardless of their closeness. No one else is allowed to touch or use it, not even the husband himself, except with the wife‟s consent and willingness. This study discusses Imam Syafi‟i‟s opinion on the discrepancy between the mahar mentioned in the marriage contract (ijab qabul) and what is actually given by the husband to the wife, with a case study in Simpang Empat Village, Lengkiti Subdistrict, Ogan Komering Ulu Regency. The background of this research is the phenomenon in society where the mahar stated during the marriage contract often does not match the mahar actually given, due to economic factors, mutual agreements, or other technical reasons. The aim of this study is to investigate the practice of giving mahar that does not align with the ijab qabul and to analyze Imam Syafi‟i‟s perspective on this issue. The research method used is descriptive and falls under the category of field research, which is conducted in real-life settings to specifically and realistically discover what is happening within the community. The results show that the practice of mahar discrepancies still occurs and is socially accepted as long as there is mutual consent from both parties. However, according to Imam Syafi‟i, the marriage remains valid despite the discrepancy in mahar, but the husband is still obliged to fulfill the mahar as stated in the contract, unless the wife explicitly waives the shortfall
