Abstract

ABSTRAK BUMDes adalah instrumen strategis pembangunan ekonomi desa untuk meningkatkan Pendapatan Asli Desa (PADesa) dan kesejahteraan masyarakat melalui pengelolaan potensi lokal. Pasal 13 poin (1) dan (2) Peraturan Bupati Pesawaran Nomor 52 Tahun 2016 menyatakan: (1) Penasehat sebagai komisaris sebagaimana dimaksud Pasal 11 ayat (1) huruf a dijabat secara ex officio oleh Kepala Desa. (2) Penasehat sebagaimana dimaksud pada ayat (1) berkewajiban: a. Memberikan nasihat kepada Pelaksana Operasional dalam melaksanakan pengelolaan BUMDesa; b. Memberikan saran dan pendapat mengenai masalah penting bagi pengelolaan BUMDesa; dan c. Mengendalikan pelaksanaan kegiatan pengelolaan BUMDesa. Rumusan masalah penelitian ini adalah: (1) Bagaimana implementasi Pasal 13 Peraturan Bupati Pesawaran Nomor 52 Tahun 2016 tentang peran kepala desa terhadap BUMDes di Desa Mulyosari; dan (2) Bagaimana perspektif Siyasah Tanfidziyyah terhadap pelaksanaan peran kepala desa sebagai penasihat ex officio dalam pengelolaan BUMDes. Penelitian menggunakan metode kualitatif lapangan dengan wawancara, observasi, dan dokumentasi. Informan penelitian terdiri dari Direktur, Sekretaris, Bendahara BUMDes, Pengurus Unit Gas, Pengurus Unit AMDK, Mitra BUMDes, serta masyarakat. Data dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan implementasi Pasal 13 di Desa Mulyosari belum optimal. Arahan kepala desa bersifat umum, pengawasan kurang intensif, rapat jarang, dan evaluasi tidak terstruktur. Hal ini melemahkan fungsi BUMDes, sehingga unit usaha berjalan sendiri tanpa sinergi dengan pemerintah desa. Dari perspektif Siyasah Tanfidziyyah, kondisi tersebut menunjukkan lemahnya pelaksanaan amanah kepemimpinan. Dari perspektif Siyasah Maliyah, pengelolaan dana dan aset belum transparan dan akuntabel, sehingga tujuan peningkatan ekonomi masyarakat tidak tercapai. ABSTRACT Village-Owned Enterprises (Badan Usaha Milik Desa or BUMDes) serve as strategic instruments for rural economic development, aiming to increase Village Original Revenue (Pendapatan Asli Desa or PADesa) and improve community welfare through the management of local potential. Article 13, points (1) and (2) of Pesawaran Regent Regulation No. 52 of 2016 stipulates: (1) The advisor acting as commissioner, as referred to in Article 11 paragraph (1) letter a, is held Ex Officio by the respective Village Head. (2) The advisor as referred to in paragraph (1) is responsible for: a. Providing advice to the Operational Executives in managing the BUMDes; b. Offering suggestions and opinions on matters considered important for BUMDes governance; and c. Supervising the implementation of BUMDes management activities. The research questions in this study are: (1) How is Article 13 of Pesawaran Regent Regulation No. 52 of 2016 implemented regarding the Village Head’s role in BUMDes in Mulyosari Village? and (2) What is the perspective of Siyasah Tanfidziyyah on the implementation of the Village Head’s role as an Ex Officio advisor in BUMDes governance? This study employs a qualitative field research method using interviews, observation, and documentation. The research informants consist of the Director, Secretary, Treasurer of BUMDes, Gas Unit Manager, AMDK Unit Manager, BUMDes partners, and the community. The data were analyzed using a descriptive qualitative approach. The findings indicate that the implementation of Article 13 in Mulyosari Village has not been optimal. The Village Head only provided general directions without intensive supervision, while official meetings were rarely held and evaluations were not well structured. This condition weakened the institutional function of BUMDes, causing the business units to operate independently without synergy with the village government. From the perspective of Siyasah Tanfidziyyah, this reflects weak execution of leadership responsibilities. From the perspective of Siyasah Maliyah, financial and asset management were neither transparent nor accountable, thus failing to achieve the goal of improving the village economy.
