Abstract

ABSTRAK Penelitian ini membahas perlindungan konsumen atas penggunaan jasa Nail Art ditinjau dari perspektif hukum Islam, dengan studi di Windy Beauty Extension Sukoharjo 1 Pringsewu. Latar belakang dari penelitian ini berangkat dari fenomena meningkatnya minat masyarakat, khususnya wanita muslimah, terhadap layanan kecantikan modern seperti Nail Art yang kini menjadi tren dan bagian dari gaya hidup. Meskipun memberikan nilai estetika dan menunjang penampilan, layanan ini juga menimbulkan berbagai risiko, seperti iritasi kulit, kerusakan kuku, serta penggunaan bahan-bahan yang belum tentu jelas dari segi keamanan dan kehalalannya. Dalam konteks masyarakat muslim, hal ini menjadi perhatian serius karena Islam menekankan pentingnya kehalalan, kebersihan, serta keadilan dalam setiap transaksi, termasuk dalam jasa kecantikan. Transaksi jasa dalam hukum Islam harus memenuhi prinsip transparansi, kejujuran, dan tidak merugikan salah satu pihak, terutama konsumen yang sering berada dalam posisi rentan. Penelitian ini bertujuan untuk mengetahui 1) Bagaimana Praktik Jasa Nail Art di Windy Beauty Extension Sukoharjo 1 Pringsewu 2) Bagaimana Perlindungan Konsumen Atas Penggunaan Jasa Nail Art di Windy Beauty Extension Perspektif Hukum Islam. Metode yang digunakan adalah kualitatif deskriptif dengan pendekatan studi lapangan (field research) dan kepustakaan. Sumber data yang digunakan pada penelitian ini adalah data primer dan data sekunder. Adapun data primer dihasilkan dari observasi dan wawancara dari pemilik usaha jasa Nail Art Windy Beauty Extension Sukoharjo, Pringsewu, Lampung. Adapun data sekunder diperoleh dari Al-Qur’an, Hadits, buku buku yang relevan dengan penelitian, jurnal hukum, dokumen, dan karya ilmiah lainnya untuk mencari teori-teori yang sesuai. Penelitian ini dianalisis dengan pendekatan Maqāṣid al-Syarī„ah serta prinsip-prinsip perlindungan konsumen dalam Islam seperti keadilan, kejujuran, transparansi, dan tanggung jawab. Hasil penelitian menunjukkan bahwa praktik jasa nail art di Windy Beauty Extension Sukoharjo 1 Pringsewu telah berjalan sesuai prosedur layanan kecantikan dan memberikan kenyamanan bagi konsumen. Dalam perspektif hukum Islam, perlindungan konsumen dapat ditingkatkan melalui penegasan akad dan tanggung jawab atas keluhan. Prinsip syariah seperti ṣidq, amanah, dan „adālah telah tercermin dalam pelayanan, serta penerapan nilai ḥifẓ al-nafs dalam Maqāṣid al-Syarī„ah telah berjalan dengan cukup baik dan sejalan dengan nilai-nilai moral dalam Islam, meskipun masih terdapat ruang untuk penyempurnaan agar lebih komprehensif. Kata Kunci: Perlindungan Konsumen, Nail Art, Hukum Islam, Maqāṣid al Syarī„ah iii ABSTRACT This research discusses consumer protection in the use of Nail Art services from an Islamic legal perspective, with a case study at Windy Beauty Extension Sukoharjo 1 Pringsewu. The background of this study arises from the phenomenon of increasing public interest, especially among Muslim women, in modern beauty services such as Nail Art, which has now become a trend and part of lifestyle. Although it provides aesthetic value and enhances appearance, this service also poses various risks, such as skin irritation, nail damage, and the use of materials whose safety and halal status may not be clearly defined. In the context of Muslim society, this becomes a serious concern because Islam emphasizes the importance of halal, cleanliness, and justice in every transaction, including beauty services. Service transactions in Islamic law must meet the principles of transparency, honesty, and fairness, ensuring that no party is harmed, particularly consumers who are often in a vulnerable position. This study aims to find out: 1) How is the practice of Nail Art services at Windy Beauty Extension Sukoharjo 1 Pringsewu? 2) How is consumer protection in the use of Nail Art services at Windy Beauty Extension from an Islamic legal perspective? The method used is descriptive qualitative with a field research approach and literature study. The data sources used in this study are primary and secondary data. Primary data is obtained through observation and interviews with the owner of the Nail Art service business at Windy Beauty Extension Sukoharjo, Pringsewu, Lampung. Secondary data is obtained from the Qur'an, Hadith, books relevant to the study, legal journals, documents, and other scholarly works to find appropriate theories. This research is analyzed using the Maqāṣid al-Syarī„ah approach and the principles of consumer protection in Islam, such as justice, honesty, transparency, and responsibility. The research findings indicate that the nail art services at Windy Beauty Extension Sukoharjo 1 Pringsewu have been carried out in accordance with beauty service procedures and have provided comfort to customers. From the perspective of Islamic law, consumer protection can be enhanced through the establishment of clear contracts (akad) and greater responsibility in handling complaints. Sharia principles such as ṣidq (honesty), amanah (trustworthiness), and „adālah (justice) are reflected in the service, and the application of the value of ḥifẓ al-nafs within the framework of Maqāṣid al-Syarī„ah has been implemented fairly well and aligns with Islamic moral values, although there is still room for improvement to make it more comprehensive.
