Abstract

ABSTRAK Lalu lintas dianggap sebagai alat transportasi darat dalam rangka pemenuhan kebutuhan baik sebagai jalur pendistribusian barang maupun jasa. Namun struktur jalan yang tersedia di dalam sistem transportasi darat Indonesia belum bisa memberikan layanan yang memadai mengingat beberapa jalan yang berada Di desa Kendalisodo, Bumi Nabung Timur yang begitu memperhatikan dan perlu adanya pengawasan dari pemerintah setempat terkait adanya pelanggaran dari kendaaraan muatan angkutan barang. Sebagaimana peraturan yang telah ditetapkan oleh pemerintah dalam Undang-Undang Pasal 19 Nomor 22 Tahun 2009 tentang Lalu Lintas Jalan dan Angkutan Jalan. Menetapkan batas maksimal muatan yang boleh dibawa oleh kendaraan pengangkut barang. Peraturan ini memberikan pedoman yang jelas tentang batasan muatan serta sanksi yang akan diberikan pada pelanggar Lalu Lintas Jalan. Rumusan masalah penelitian ini adalah Bagaimana Implementasi Pasal 19 Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas Jalan dan Angkutan Jalan Yang di Sebabkan Oleh Pengaruh Beban Berlebih Mobil Pengangkut Singkong Di desa Kendali Sodo, kelurahan Bumi Nabung timur? Dan Bagaimana Tinjauan Fiqh Siyasah Tanfidziyah Terhadap Implementasi Pasal 19 Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Jalan Dan Angkutan Jalan Yang di Sebabkan Oleh Pengaruh Beban Berlebih Mobil Pengangkut Singkong di Desa Kendali Sodo, Bumi Nabung Timur? Hasil penelitian ini dapat disimpulkan (1) Implementasi Pasal 19 Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Jalan Dan Angkutan Jalan Yang Disebabkan Oleh Pengaruh Beban Berlebih Mobil Pengangkut Singkong, ternyata belum berjalan secara optimal khususnya terkait dengan permasalahan kerusakan jalan, khususnya terkait dengan permasalahan kerusakan jalan. Masih banyak jalan berlubang yang perlu diperbaiki. Selain itu, belum adanya Tindakan tegas dari kepala kampung terhadap pemilik singkong yang mengangkut muatan yang melebihi ketentuan Undang-Undang. (2) Analisis Fiqih Siyasah Tanfidziyah terhadap Implementasi Pasal 19 Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Jalan Dan Angkutan Jalan Yang Disebabkan Oleh Pengaruh Beban Berlebih Mobil Pengangkut Singkong belum sesuai dengan Fiqh Siyasah Tanfidziyah. Dalam praktik masih ditemukan sejumlah peraturan yang belum dijalankan sebagaimana mestinya. Ketiadaan tindakan yang konkret dalam penerapan peraturan ini menunjukakan adanya kelemahan dari segi pemahaman hukum, efektivitas kepemimpinana, maupun pengawasan dari pihak yang berwewenang. Kata Kunci : Implementasi, Peraturan Jalan Dan Angkutan Jalan, Muatan Berlebih, Pengawasan Trasportasi, Penegakan Hukum iii ABSTRACT Road traffic is a primary need for the public, providing essential transportation access for daily activities and needs. Road traffic is considered a means of land transportation, essential for fulfilling needs, both as a distribution channel for goods and services. Good roads ensure the continuity of a sound land transportation system. However, the existing road structure within Indonesia's land transportation system is still inadequate to provide adequate services, given that several roads in Kendalisodo Village, East Bumi Nabung, require close attention and require oversight by the local government regarding violations of traffic regulations. As stipulated by the government, Law No. 22 of 2009 concerning Road Traffic and Road Transportation stipulates the maximum load limit that goods vehicles may carry. This regulation provides clear guidelines on load limits and the sanctions that will be imposed on Road Traffic violators. The formulation of the research problem is: How is the Implementation of Article 19 of Law Number 22 of 2009 concerning Road Traffic and Road Transportation Caused by the Influence of Excessive Loads of Cassava Transport Vehicles in Kendali Sodo Village, East Bumi Nabung Subdistrict? And How is the Review of Fiqh Siyasah Tanfidziyah Regarding the Implementation of Article 19 of Law Number 22 of 2009 concerning Road Traffic and Road Transportation Caused by the Influence of Excessive Loads of Cassava Transport Vehicles in Kendali Sodo Village, East Bumi Nabung Subdistrict? The results of this study can be concluded (1) The Implementation of Article 19 of Law Number 22 of 2009 concerning Road Traffic and Road Transportation Caused by the Influence of Excessive Loads of Cassava Transport Vehicles, has not been running optimally, especially related to the problem of road damage, especially related to the problem of road damage. There are still many potholes that need to be repaired. Furthermore, there has been no firm action from the village head against cassava owners who transport loads exceeding the legal limits. (2) Analysis of the Fiqh Siyasah Tanfidziyah (Islamic Jurisprudence) on the Implementation of Article 19 of Law Number 22 of 2009 concerning Road Traffic and Road Transportation Caused by the Influence of Excessive Loads on Cassava Transport Vehicles is not in accordance with the Fiqh Siyasah Tanfidziyah (Islamic Jurisprudence). In practice, a number of regulations have not been implemented properly. The absence of concrete action in implementing these regulations indicates weaknesses in terms of legal understanding, leadership effectiveness, and oversight by the authorities.
