Abstract
ABSTRAK Eksistensi aktivitas jual beli fan-art merchandise pada toko online Catporium pembuatannya melalui proses kreatif dan interpretasi pribadi menghasilkan ekspresi dalam seni gambar terinspirasi dari grup musik Korean Band (K-Band) Day6 yang disukainya. Memperhatikan bahwa di satu sisi hak cipta fan-art ada bersamaan dengan terwujudnya karya dan akan melekat pada pembuatnya tanpa harus mencatatkan karyanya. Namun, benturan kepentingan dapat terjadi ketika karya ini bergerak ke ranah jual beli melibatkan penggunaan elemen dari grup K-Band Day6 sebagai representasi ikon dalam desain fan-art merchandise yang dibuat tanpa izin berkolaborasi atau tidak memiliki lisensi dari pihak bersangkutan terlebih dahulu. Penelitian ini mengkaji permasalahan tentang bagaimana praktik jual beli fan-art merchandise tanpa hak cipta pada toko online Catporium dan bagaimana tinjauan hukum Islam tentang praktik jual beli fan art merchandise tanpa hak cipta pada toko online Catporium. Penelitian ini menggunakan metode kualitatif, jenis studi lapangan. Pengumpulan data melalui wawancara dan dokumentasi. Data primer diperoleh langsung dari informan, yaitu penjual dan pembeli pada toko online Catporium. Data sekunder berupa teori jual beli dalam hukum Islam dan hak cipta dalam hukum Islam, serta data penunjang terkait fokus penelitian ini untuk dilakukan analisis deskriptif lebih mendalam. Hasil penelitian menunjukkan praktik jual beli fan-art merchandise pada toko online Catporium tata cara transaksinya sama dengan jual beli produk online pada umumnya. Ada penjual dan pembeli yang berakad (sighat). Pembeli membayar sesuai harga yang ditetapkan penjual. Penyerahan produk ditangguhkan sesuai kesepakatan. Objek akadnya fan-art merchandise K-Band Day6. Ungkapan ijab qabul secara tulisan dengan mengisi g-form dan konfirmasi melalui DM. Tinjauan hukum Islam tentang praktik jual beli fan-art merchandise tanpa hak cipta pada toko online Catporium berpotensi menimbulkan permasalahan hukum dan berisiko batal dilihat dari objeknya, termasuk karya derivatif. Dalam hukum Islam, hak cipta disebut Hak Ibtikar. Sekalipun penjual mematuhi aturan tidak tertulis yang hidup di antara komunitas pembuat fan-art merchandise, jual beli dapat dianggap sah bergantung pada kebijakan pihak Day6. Agensi pemegang hak cipta dapat mengungkapkan keberatan, melarang, menghapus, menghentikan, menuntut hak royalti, dan menggugat atas segala tindakan yang muncul terkait hak milik utuh (milk tam) atas kekayaan intelektual pihak Day6 dalam praktik penjualan fan-art merchandise tersebut. Kata Kunci: Hukum Islam, Jual Beli, Fan-art Merchandise, Hak Cipta ABSTRACT The existence of fan art merchandise trading activities on the Catporium online store is a creative process and personal interpretation, resulting in artistic expressions inspired by the Korean band (K-Band) Day6, a favorite of the artist. While copyright for fan art exists simultaneously with the creation of the work and remains with the creator without the need for registration, conflicts of interest can arise when this work enters the realm of trading, involving the use of elements from the K-Band Day6 as iconic representations in fan art merchandise designs created without prior collaboration or licensing from the relevant parties. This study examines the practice of buying and selling fan art merchandise without copyright on the Catporium online store and the Islamic legal perspective on this practice. This research uses a qualitative method, a field study. Data collection was conducted through interviews and documentation. Primary data was obtained directly from informants, namely sellers and buyers on the Catporium online store. Secondary data, including theories of buying and selling in Islamic law and copyright in Islamic law, were used, as well as supporting data related to the focus of this research for further in-depth descriptive analysis. Research results show that the transaction process for buying and selling fan art merchandise on the Catporium online store is similar to that for buying and selling online products in general. A seller and buyer enter into a contract (sighat). The buyer pays the price set by the seller. Product delivery is deferred as agreed. The object of the contract is Day6 K-Band fan art merchandise. The acceptance and acceptance are expressed in writing by filling out a g-form and confirming it via DM. A legal review of the practice of buying and selling fan art merchandise without copyright on the Catporium online store has the potential to raise legal issues and risk invalidation, considering the object, including derivative works. In Islamic law, copyright is referred to as Hak Ibtikar (right of acceptance). Even if the seller complies with the unwritten rules prevailing among the fan art merchandise community, the sale may be deemed valid depending on Day6's policies. The copyright holder agency can express objections, prohibit, delete, stop, demand royalty rights, and sue for any actions that arise regarding the full ownership rights (milk tam) of Day6's intellectual property in the practice of selling fan-art merchandise.
