Abstract

ABSTRAK Pada Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 Tentang Penyelenggaraan Bidang Jaminan Produk Halal yang diterapkan di setiap daerah tentu memiliki tantangan. Peraturan ini menjadi salah satu dasar hukum yang telah dibuat oleh pemerintah sebagai bentuk untuk memberikan kepastian hukum dan jaminan bagi masyarakat atas kehalalan produk. Berdasarkan hal tersebut sangat wajib dilaksanakan oleh pelaku usaha mikro dan kecil sebagai bentuk pertanggungjawaban terhadap produk yang dijual. Dalam penelitian ini dirumuskan permasalahannya yaitu Bagaimana implementasi Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 tentang Penyelenggaraan Bidang Jaminan Produk Halal di Kelurahan Kelurahan Metro Kecamatan Metro Pusat Kota Metro dan Bagaimana tinjauan fiqh siyasah terhadap implementasi Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 tentang Penyelenggaraan Bidang Jaminan Produk Halal di Kelurahan Kelurahan Metro Kecamatan Metro Pusat Kota Metro . Penelitian ini bertujuan mengetahui implementasi Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 tentang Penyelenggaraan Bidang Jaminan Produk Halal di Kelurahan Kelurahan Metro Kecamatan Metro Pusat Kota Metro dan untuk mengetahui tinjauan fiqh siyasah terhadap implementasi Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 tentang Penyelenggaraan Bidang Jaminan Produk Halal. Jenis penelitian ini merupakan penelitian lapangan (field research), dengan penelitian deskriptif kualitatif yang bersifat analisis. Metode pengumpulan data dilakukan dengan observasi, wawancara, dan dokumentasi yang dilakukan kepada pelaku usaha mikro dan kecil yang belum bersertifikat halal di Kelurahan Kelurahan Metro Kecamatan Metro Pusat Kota Metro. Kemudian populasi dan sampel dalam penelitian ini terdapat 5 pelaku usaha mikro dan kecil yang sudah besertifikat halal dan 5 pelaku usaha mikro dan kecil yang sudah besertifikat halal. Hasil dari penelitian ini menunjukan bahwa pertama pada implementasi Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 tentang Penyelenggaraan Bidang Jaminan Produk Halal di Kelurahan Metro Kecamatan Metro Pusat Kota Metro belum sepenuhnya terlaksana karena masih terdapat penghambat seperti kurangnya informasi, edukasi dari pemerintah, dan kurangnya kesadaran pelaku usaha mikro dan kecil terkait kewajiban memiliki sertifikat halal. Kedua, berdasarkan pandangan Fiqh Siyasah yaitu dalam Siyasah Tanfidziyyah Syar’iyyah yang merupakan pelaksana Perundang-undangan, bahwa Pasal 79 Ayat 1 Peraturan Pemerintah Nomor 39 Tahun 2021 Tentang Penyelenggaraan Bidang Jaminan Produk Halal belum terlaksana dengan sepenuhnya, hal ini karena kurangnya ketaatan Masyarakat mengenai kewajiban bersertifikat halal. ABSTRACT I n Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector which is implemented in each region certainly has challenges. This regulation is one of the legal bases that has been made by the government as a form of providing legal certainty and guarantees for the community regarding the halalness of products. Based on this, it is mandatory for micro and small business actors to implement it as a form of accountability for the products sold. In this study, the problem is formulated, namely How is the implementation of Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector in Kelurahan Metro, Metro District, Metro Center, Metro City and How is the review of fiqh siyasah regarding the implementation of Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector in Kelurahan Metro, Metro District, Metro Center, Metro City. This study aims to determine the implementation of Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector in Kelurahan Metro, Metro Pusat District, Metro City and to determine the review of fiqh siyasah on the implementation of Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector. This type of research is field research, with qualitative descriptive research that is analytical in nature. The data collection method is carried out by observation, interviews, and documentation carried out on micro and small business actors who have not been halal certified in Kelurahan Metro, Metro Pusat District, Metro City. Then the population and sample in this study there are 5 micro and small business actors who have been halal certified and 5 micro and small business actors who have been halal certified. The results of this study indicate that first, the implementation of Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector in Metro Village, Metro District, Metro City Center has not been fully implemented because there are still obstacles such as lack of information, education from the government, and lack of awareness of micro and small business actors regarding the obligation to have a halal certificate. Second, based on the Fiqh Siyasah view, namely in Siyasah Tanfidziyyah Syar'iyyah which is the implementer of the Legislation, that Article 79 Paragraph 1 of Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Assurance Sector has not been fully implemented, this is due to the lack of community compliance regarding the obligation to have a halal certificate.
