Abstract

ABSTRAK Jual beli dengan janji sepihak yang di lakukan oleh calon pembeli kepada pedagang merupakan aktivitas jual beli yang terjadi di Pasar KT Desa Margorejo Kecamatan Kotabumi Utara Lampung Utara. Calon pembeli yang memberi janji (Wa’ad) kepada pihak pedagang secara sepihak, dia berjanji akan kembali untuk membeli barang yang telah di pilih sebelumnya oleh calon pembeli, namun dalam hal ini tidak ada kepastian waktu kapan calon pembeli akan datang untuk membeli barang yang telah di pilih dan ada calon pembeli yang tidak menepati janjinya. Rumusan masalah dalam penelitian ini yaitu, Bagaimana bentuk janji sepihak pembeli pada pedagang dalam jual beli di Pasar KT Desa Margorejo Kecamatan Kotabumi Utara Lampung Utara dan Bagaiman perspektif hukum ekonomi syariah tentang bentuk janji sepihak pembeli pada pedagang dalam jual beli di Pasar KT Desa Margorejo Kecamatan Kotabumi Utara Lampung Utara. Jenis penelitian ini menggunakan penelitian lapangan (Field Research) dan sifat penelitian ini yaitu deskriptif analisis. Sumber data yang digunakan adalah data primer dan data sekunder. Metode Pengumpulan data meliputi wawancara, dan dokumentasi. Metode pengolahan data yaitu editing, klasifiksi dan sistematis data, kemudian data analisis dengan metode kualitatif dengan pendekatan berfikir secara induktif. Jumlah sampel sebanyak 10 orang pedagang dan 3 orang pembeli. Praktik Jual beli dengan janji sepihak merupakan salah satu aktivitas jual beli yang dilakukan oleh pedagang di Pasar KT Desa Maergorejo Kecamatan Kotabumi Utara Kabupaten Lampung Utara. Janji sepihak calon pembeli kepada pedagang Pasar KT, yang berjanji ingin membeli barang yang telah dipilih olehnya di masa mendatang dan meminta pedagang untuk menyimpan barang yang telah dipilih hingga calon pembeli yang berjanji tersebut datang untuk membeli barang tersebut. Berdasarkan hasil penelitian Praktik Jual Beli Dalam Bentuk Janji Sepihak Perspektif Hukum Ekonomi Syariah yang terjadi pada pedagang di Pasar KT Desa Margorejo Kecamatan Kotabumi Utara Lampung Utara dilakukan secara langsung di pasar dan Janji yang di berikan oleh calon pembeli dilakukan dengan tidak ada paksaan dan dalam kesadaran penuh oleh pemberi Wa’ad (calon pembeli) dan pihak pedagang tidak mempermasalahkan Wa’ad yang dilakukan oleh calon pembeli, karena tidak ada pihak yang merasa dirugikan baik pedagang maupun calon pembeli, dalam tinjauan hukum Islam sudah memenuhi syarat hukum Wa’ad, oleh sebab itu hukumnya mubah (boleh) karena tidak melanggar ketentuan syara’ serta dengan terpenuhi syarat melaksanakan Wa’ad. ABSTRACT Buying and selling with unilateral promises made by prospective buyers to traders is a buying and selling activity that occurs at the KT Market, Margorejo Village, North Kotabumi District, North Lampung. Prospective buyers who give promises (Wa'ad) to the trader unilaterally, he promises to return to buy goods that have been previously selected by the prospective buyer, but in this case there is no certainty when the prospective buyer will come to buy the goods that have been selected and there are prospective buyers who do not keep their promises. The formulation of the problem in this study is, How is the form of unilateral promises of buyers to traders in buying and selling at the KT Market, Margorejo Village, North Kotabumi District, North Lampung, and what is the perspective of sharia economic law on the form of unilateral promises of buyers to traders in buying and selling at KT Market, Margorejo Village, North Kotabumi District, North Lampung. This type of research uses field research and the nature of this research is descriptive analysis. The data sources used are primary data and secondary data. Data collection methods include interviews, and documentation. The data processing methods are editing, classification and systematic data, then data analysis with qualitative methods with an inductive thinking approach. The sample size consisted of 10 traders and 3 buyers The practice of buying and selling with unilateral promises is one of the buying and selling activities carried out by traders at the KT market, Maergorejo Village, North Kotabumi District, North Lampung Regency. A unilateral promise of a prospective buyer to a KT market trader, who promises to buy the goods that have been chosen by him in the future and asks the trader to keep the goods that have been selected until the promised prospective buyer comes to buy the goods. Based on the results of the research on the Practice of Buying and Selling in the Form of Unilateral Promises from the Perspective of Sharia Economic Law that occurred to traders at the KT Market, Margorejo Village, North Kotabumi District, North Lampung, it was carried out directly in the market and the promises given by prospective buyers were carried out without coercion and in full awareness by the giver of the Wa'ad (prospective buyer) and the trader did not have a problem with the Wa'ad carried out by the prospective buyer, because no party feels disadvantaged either traders or prospective buyers, in the review of Islamic law has met the requirements of Wa'ad law, therefore the law is mubah (permissible) because it does not violate the provisions of sharia and by fulfilling the conditions for carrying out Wa'ad.
