Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui peran Badan Pengawas Pemilu (Bawaslu) Kota Bandar Lampung dalam implementasi Undang-Undang Nomor 7 Tahun 2017, khususnya Pasal 372 tentang pemungutan suara ulang (PSU), dengan perspektif fiqh siyasah Tanfidziyah. Berdasarkan Undang-undang No 7 Tahun 2017 Pasal 372 Ayat (2) huruf a yang mengatur tentang prosedur pemungutan suara ulang yang harus dilakukan apabila terdapat indikasi pelanggaran yang dapat mempengaruhi hasil pemilu. Untuk mengatasi permasalahan diatas maka perlu adanya perspektif Fiqh Si sah Tanfiżiyah yang berfokus pada prinsip-prinsip pemerintahan dan tata kelola yang baik menurut hukum Islam dan memberikan landasan untuk menilai bagaimana Bawaslu menjalankan perannya dalam menjaga kemaslahatan umat (public welfare) dan keadilan sosial, berdasarkan tujuan di atas, maka rumusan masalah dalam penelitian ini yaitu: 1) Bagaimana Peran Bawaslu Kota Bandar Lampung dalam implementasi Undang-Undang Nomor 7 Tahun 2017 Pasal 372 Ayat (2) huruf a Tentang Pemungutan Suara Ulang di TPS 19 Kelurahan Way Kandis Kecamatan Tanjung Senang Pemilu 2024. 2) Bagaimana Prespektif Fiqh Si s h T nfiżiyah terhadap Peran Bawaslu Kota Bandar Lampung dalam menangani Pemungutan Suara Ulang di TPS 19 Kelurahan Way Kandis Kecamatan Tanjung Senang Pemilu 2024. Penelitian ini menggunakan pendekatan kualitatif dengan metode pengumpulan data yaitu observasi, wawancara, dan dokumentasi. Teknik pengambilan sampel menggunakan teknik total sampling dengan 8 sampel yang digunakan. Metode analisis data yang digunakan adalah metode induktif yang mana penulis melakukan perbandingan antara teori dengan permasalahan yanng terjadi di lapangan. Hasil dari penelitian ini menunjukkan bahwa Peran Bawaslu Kota Bandar Lampung dalam pemungutan suara ulang di TPS 19 Kelurahan Way Kandis Kecamatan Tanjung Senang sesuai dengan Undang-Undang Nomor 7 Tahun 2017, khususnya Pasal 372 Ayat (2) huruf a sudah terlaksanakan dengan baik berdasarkan dengan juknis yang diberikan oleh KPU. Selain itu, menurut tinjauan Fiqh Si sah Tanfiżiyah bahwa pemungutan suara ulang sudah berjalan dengan baik berdasarkan firman Allah SWT QS. An-Nisa ayat 59. ABSTRACT This study aims to determine the role of the Election Supervisory Body (Bawaslu) of Bandar Lampung City in implementing Law Number 7 of 2017, especially Article 372 concerning re-voting (PSU), from the perspective of fiqh siyasah Tanfidziyah. Based on Law Number 7 of 2017 Article 372 Paragraph (2) letter a which regulates the re-voting procedure that must be carried out if there are indications of violations that can affect the election results. To overcome the above problems, it is necessary to have a Fiqh Siyāsah Tanfiżiyah perspective that focuses on the principles of good governance and governance according to Islamic law and provides a basis for assessing how Bawaslu carries out its role in maintaining public welfare and social justice, based on the above objectives, the formulation of the problem in this study is: 1) How is the Role of Bawaslu of Bandar Lampung City in implementing Law Number 7 of 2017 Article 372 Paragraph (2) letter a Concerning Re-voting at TPS 19, Way Kandis Village, Tanjung Senang District, 2024 Election. 2) How is the Fiqh Siyāsah Tanfiżiyah Perspective on the Role of Bawaslu of Bandar Lampung City in handling Re-voting at TPS 19, Way Kandis Village, Tanjung Senang District, 2024 Election. This study uses a qualitative approach with data collection methods, namely observation, interviews, and documentation. The sampling technique uses a total sampling technique with 8 samples used. The data analysis method used is an inductive method in which the author compares theory with problems that occur in the field. The results of this study indicate that the role of Bawaslu Bandar Lampung City in the re-voting at TPS 19, Way Kandis Village, Tanjung Senang District in accordance with Law Number 7 of 2017, especially Article 372 Paragraph (2) letter a has been implemented properly based on the technical instructions provided by the KPU. In addition, according to the review of Fiqh Siyāsah Tanfiżiyah, the re-voting has gone well based on the word of Allah SWT QS. An-Nisa verse 59.
