Abstract

ABSTRAK Dalam Islam, upah-mengupah atau al-ijarah yang menurut bahasa adalah al-iwadh yang artinya adalah ganti dan upah. Dalam mengservis tas di service tas, konsumen/pelanggan memberikan upah sebagai imbalan dari hasil pekerjaan yang dilakukan oleh jasa servis, pembayaran upah pada servis tas DR Kecamatan Kemiling lebih sering dibayarkan setelah tas tersebut selesai dikerjakan. Namun, dalam praktiknya terdapat sedikit banyak konsumen/pelanggan yang tidak mengambil tas hasil servis tersebut, sedangkan jasa servis telah menyelesaikan pekerjaan tersebut dan membutuhkan upahnya dibayarkan segera. Dengan tidak diambilnya tas tersebut, pihak jasa servis tas tidak mendapatkan upah yang seharusnya ia terima sebagai imbalan dari pekerjaan yang telah ia kerjakan. Rumusan masalah dalam penelitian ini adalah, bagaimana praktik penundaan pembayaran upah jasa service tas pada jasa service tas DR Kecamatan Kemiling Kota Bandar Lampung dan bagaimana Tinjauan Hukum Ekonomi Syariah terhadap penundaan pembayaran upah jasa service tas pada service tas DR Kecamatan Kemiling Kota Bandar Lampung. Jenis penelitian ini merupakan penelitian lapangan (Field Research), penelitian ini bersifat deskriptif yang dilakukan pada Service Tas DR. Sumber data yang digunakan adalah data primer yaitu data yang diperoleh dari hasil wawancara dan dokumentasi, sumber data sekunder yaitu data yang diperoleh melalui studi pustaka atau penelaahan buku-buku, atau jurnal yang berkaitan dengan penelitian ini. Adapun analisa data yang digunakan dalam penelitian ini adalah dengan metode deskriptif kualitatif. Berdasarkan hasil penelitian dikemukakan bahwa terdapat tiga metode pembayaran yang pertama bayar penuh di awal, yang kedua metode Down Payment (Uang Muka) yaitu uang muka yang dibayarkan berapa saja dan yang ketiga pembayaran secara penuh diakhir. Namun, pada praktiknya yang sering kali terjadi penundaan pembayaran yaitu dengan metode pembayaran diakhir setelah pekerjaan telah selesai dikerjakan berdasarkan kesepakatan para pihak. Adanya penundaan pembayaran biaya/upah jasa servis tas karena pihak konsumen/pelanggan tidak adanya kesepakatan waktu yang jelas kapan konsumen membayarkan upah dan mengambil tas yang sudah selesai dikerjakan oleh pihak jasa servis tas. Hal tersebut berdampak pada kehidupan sehari hari pemilik jasa servis dalam memenuhi kebutuhan pokoknya. Tidak memenuhi upah pekerja adalah suatu kedzaliman yang tidak disukai Allah Swt. Penundaan pembayaran upah jasa service tas berdasarkan alasan konsumen yaitu penundaan dengan alasan sah adalah keterbatasan keuangan atau keadaan darurat dapat diterima dalam hukum Islam. Namun, penundaan tanpa alasan yang jelas melanggar prinsip keadilan dan Amanah dapat dianggap sebagai bentuk kedzoliman. Umat Islam juga diberikan kebebasan untuk menentukan waktu pembayaran upah sesuai kesepakatan antara pekerja dengan yang mempekerjakannya. In servicing bags at bag services, consumers/customers provide wages as compensation for the work done by the service, payment of wages at the DR bag service in Kemiling District is more often paid after the bag is finished. However, in practice there are more or less consumers/customers who do not take the bags from the service, while the service has completed the work and needs their wages paid immediately. By not taking the bag, the bag service party does not get the wages that they should receive as compensation for the work they have done. The formulation of the problem in this study is, how is the practice of delaying payment of wages for bag service services at the DR bag service in Kemiling District, Bandar Lampung City and how is the Review of Sharia Economic Law regarding the delay in payment of wages for bag service services at the DR bag service in Kemiling District, Bandar Lampung City. This type of research is field research, this research is descriptive in nature which is conducted at the DR Bag Service. The data sources used are primary data, namely data obtained from interviews and documentation, secondary data sources, namely data obtained through literature studies or review of books, or journals related to this research. The data analysis used in this study is a qualitative descriptive method. Based on the results of the study, it was stated that there are three payment methods, the first is paying in full at the beginning, the second is the Down Payment method (Advance Payment) which is a down payment paid in any amount and the third is paying in full at the end. However, in practice, there is often a delay in payment, namely the payment method at the end after the work has been completed based on the agreement of the parties. There is a delay in payment of bag service fees/wages because the consumer/customer does not have a clear agreement on when the consumer will pay the wages and take the bag that has been completed by the bag service party. This has an impact on the daily life of the service owner in meeting his basic needs. Not fulfilling workers' wages is an injustice that is not liked by Allah SWT. Delays in payment of bag service wages based on consumer reasons, namely delays with valid reasons such as financial constraints or emergencies, can be accepted in Islamic law. However, delays without clear reasons violate the principles of justice and Amanah can be considered a form of injustice. Muslims are also given the freedom to determine the time of payment of wages according to the agreement between the worker and his employer.
