Abstract

ABSTRAK Dengan melangsungkan kehidupan dimasa sekarang ini kebanyakan orang melakukan transaksi hutang piutang, terutama orang yang sudah berkeluarga atau sudah berumah tangga. Dengan berjalannya umur yang semakin panjang, kematianpun menjadi semakin dekat. Sehingga hutangpun tidak bisa dilunasi, karena kehidupan di dunia tidak diketahui batasnya, akhirnya hutang dibawa sampai mati. Rumusan masalah dalam penelitian ini adalah bagaimana praktik pelaksanaan penanggungan ketidakmampuan ahli waris membayar hutang pewaris dan bagaimana pandangan tokoh Nahdlatul Ulama tentang ketidakmampuan ahli waris membayar hutang pewaris di Desa Sinar Gunung Kecamatan Pugung Kabupaten Tanggamus. Jenis penelitian ini lapangan (field research) bersifat deskriptif. Sumber data yang digunakan sumber data primer dan sumber data sekunder. Pengumpulan data dilakukan dengan informan penelitian, observasi, dokumentasi dan wawancara. Setelah semua data terkumpul, maka data tersebut diolah dan dianalisis secara deskriptif kualitatif dan selanjutnya ditarik kesimpulan secara deduktif. Hasil penelitian menunjukkan bahwa alasan yang menyebabkan ketidakmampuan ahli waris membayar hutang pewaris di Desa Sinar Gunung Kecamatan Pugung Kabupaten Tanggamus disebabkan oleh beberapa alasan, ada beberapa ahli waris yang berat hati untuk membayar hutang pewaris karena beralasan mencukupi kehidupan sehari-hari ataupun karena harta yang ditinggalkan pewaris tidak mencukupi untuk membayar hutang yang ditinggalkannya. Akan tetapi pihak-pihak pemberi hutang selalu menagih bahkan memberi ancaman-ancaman kepada ahli waris tersebut. Tidak hanya sampai disitu saja, keluarga dari si pemberi hutang seperti istri dan anaknya juga menceritakan dan menghasut masyarakat agar keluarga pewaris yang diberi hutang terlihat jelek dimata masyarakat. Kemudian atas asutan dari keluarga si pemberi hutang, banyak masyarakat yang tidak suka dan memandang rendah para ahli waris tersebut. Sedangkan, pandangan tokoh Nahdlatul Ulama tentang ketidakmampuan ahli waris membayar hutang pewaris di Desa Sinar Gunung Kecamatan Pugung Kabupaten Tanggamus yaitu jika ahli waris tidak sanggup untuk melunasi hutang si mayit secara keseluruhan maka ahli waris wajib membayarnya sampai batas kemampuan mereka dan jika, tetap dipaksakan untuk melunasi hutang si mayit secara keseluruhan maka nanti akan timbul kemudharatan terhadap mereka. Salah satu kemudharatan tersebut akan terganggu kelangsungan hidup mereka. Kata Kunci : Ahli Waris, Hutang Pewaris, Nahdlatul Ulama. ABSTRACT By living in the present era, most people make debt transactions, especially those who are married or have a household. As life gets longer, death becomes closer. So that debts cannot be paid off, because life in the world is not known for its limits, finally debts are carried to death. The formulation of the problem in this study is How is the practice of implementing the inability of Heirs to pay the Debt of the Heir and What are the views of Nahdlatul Ulama figures on the inability of heirs to pay the debt of the heir in Sinar Gunung Village, Pugung District, Tanggamus Regency. This type of field research is descriptive. The data sources used are primary data sources and secondary data sources. Data collection was carried out with research informants, observation, documentation and interviews. After all the data was collected, the data was processed and analyzed descriptively qualitatively and then conclusions were drawn deductively. The results of the study showed that the Practice of Implementing the Inability of Heirs to Pay the Heirs' Debts in Sinar Gunung Village, Pugung District, Tanggamus Regency was caused by several reasons, there were several heirs who were reluctant to pay the heir's debts because they argued that they were sufficient for daily life or because the assets left by the heir were not sufficient to pay the debts left behind. However, the creditors always collect and even make threats to the heirs. Not only that, the family of the creditor such as his wife and children also told and incited the community so that the family of the heir who was given the debt looked bad in the eyes of the community. Then, due to the advice of the creditor's family, many people disliked and looked down on the heirs. Meanwhile, the View of Nahdlatul Ulama Figures on the inability of heirs to pay the debts of the inheritors in Sinar Gunung Village, Pugung District, Tanggamus Regency, namely concluding that if the heirs are unable to pay off the debts of the deceased in full, then the heirs are obliged to pay it to the limit of their ability and if they are still forced to pay off the debts of the deceased in full, then later there will be harm to them.
